Town Council views 4 firefighter/paramedic swear-ins & discusses the process for charter changes (video)

The Town Council met on Wednesday, Nov 1, 2023 as scheduled.

Brief recap:

• 4 firefighter/paramedics were sworn in
• Key presentation and discussion around the Town charter and how to change it if so desired. A healthy discussion, some interesting nuances were revealed (a community with less than 6,000 can only use a town meeting format, a community with more than 12,000 can chose to use the city form of government). Likely to come forward again as part of the new Council goals setting session
• Finance Cmte meeting Nov 8 will review the budget update, still a downgrade of revenue of about $300K. Ways to manage this were found.
• Town Council will get to the budget at their Nov 15 meeting. The tax rate hearing is scheduled for Tuesday, Nov 21
• Migrant housing update, hotel now full. Coordinated efforts to help as required. Portal on the Board of Health webpage with donation listing and the migrant housing statistics. $10,000 grant received for non-emergency medical transportation. Clinic in the works with State and Federal official on work permits, lots of unknowns remain as details are still scant.

Why the 'sudden' cancelation of the Town Council meeting?

The Town Council meeting scheduled for Nov 3 when scheduled with the agenda published last week, was scheduled in advance of when it 'could' be scheduled per the Town Charter. 

The Nov 3 date is the key. While the Council generally meets on the first and third Wednesday of the month, the beginning of the new term (i.e. after an election) is prescribed in the Town Charter. The bold text in section 2-1-4 added for emphasis.

The relevant section of Article Two is shared here:

"Section 1 Composition and Membership 

2-1-1 The legislative body of the Town shall be a Town Council whose members shall be elected to meet, deliberate, act and vote in exercise of the corporate powers of the Town. 

2-1-2 Nine (9) Council members shall be nominated and elected from the Town at large, all for two-year concurrent terms of office. 

2-1-3 Town Council members shall receive no compensation for service but may be allowed expenses incurred in the performance of their official duties. 

2-1-4 The term of office of the Town Council shall begin on the second Wednesday following the election and continuing until their successors are qualified."

This is a meeting of the Franklin Town Council Sub-Committee; under the Open Meeting Law, this subcommittee is a separate "public body" from the Town Council. Therefore, unless the Town Council has separately noticed and posted its own meeting, Councilors who are not members of this subcommittee will not be permitted to speak or otherwise actively participate in this meeting, although they may attend and observe. This prohibition is necessary to avoid the potential for an Open Meeting Law Violation.

Section 1 - Appointment and qualifications

4-1-1
The Town Council, by a majority vote of its full membership, shall appoint a Town Administrator who shall administer and implement the directives and policies adopted by the Town Council. The Council shall fix the Administrator's compensation within the limits of an appropriation adopted for that purpose. The salary, benefits, and terms and conditions of employment and the procedures for dismissal shall be negotiated between the Town Council and the Administrator.

4-1-2
In seeking candidates for the Administrator's post, the Town Council shall advertise in appropriate professional journals and other suitable publications as deemed necessary. The Town Administrator need not be a resident of the town at the time of appointment but shall establish residence within the town within one year following appointment, unless the town council shall waive such residency requirement. If a resident of the Town, the successful candidate shall have held no elective town office for a period of one year prior to appointment.

4-1-3
The Administrator shall be appointed on the basis of educational, executive and administrative qualifications and experience, including at least a bachelor's degree in an appropriate field of study from an accredited four-year college or university. Professional experience shall consist of at least three (3) years of full-time, compensated service in town or town administration or related administrative activity.

16-775 at its second reading on January 18, 2017, and

WHEREAS, the proposed bylaw amendment’s sponsor desires to resubmit it to
the Town Council, and

WHEREAS, Franklin Town Council Procedures Manual, Section VIII,
Resubmission requires that a majority of the Council present at a Town Council meeting approve the resubmittal,

NOW THEREFORE, the Franklin Town Council, hereby approves the resubmittal
of Zoning Bylaw Amendment 16-775 for consideration and action, pursuant to the provisions of G.L. Chapter 40A, Section 5, applicable to the reconsideration within two years of a proposed zoning bylaw amendment which has been unfavorably acted upon.

This Resolution shall become effective according to the rules and regulations of
the Town of Franklin Home Rule Charter.

"Citing several concerns - including the hiring process - town councilors explored the possibility of revising the town charter. 

The council invited several members from past charter reviews to discuss their efforts and offer their suggestions about future amendment, if any. 

James Dacey, the chairman of the 1995 review commission, said his group was formed in response to a specific situation: the town council ballooning to 17 members. His commission recommended several changes that were adopted, including a nine-member council with concurrent, two-year terms."

"State officials determined that a propane leak caused a 2015 explosion that killed two people, though other facts have yet to be determined. 

Nancy and Richard Brown, both 66, perished as the result of the blast, which took place at their condominium at 58 Tuscany Drive on Oct. 10. 

State Fire Marshal Peter Ostroskey - along with Franklin Fire Chief Gary McCarraher and Police Chief Thomas Lynch - announced the results of their investigation on Wednesday. 

According to a release from the fire marshal's office, the leak came from one of two sources - a gas fireplace or the unit's heating system - and the cause of the ignition is still unknown. As that morning was cool, the release states, the heating system could have turned on - though the possibility that the fireplace was left running has not been ruled out. The unit's gas piping and burner have been set for future testing - that investigation will be undertaken independently by the involved insurance companies."

"According to the DOT, a trip from the New York border to Boston along the turnpike that currently costs $6.60 will go down to $6.15 under the proposed structure for a state-issued E-ZPass holder. 

But if fees the state proposes for drivers who don't travel the turnpike with an E-ZPass are approved by the board next month, motorists will pay a 60-cent mailing and processing fee after a camera captures their registration information from their license plate and sends them a bill. Additionally, drivers without E-Z Pass will pay an additional 30 cents per gantry for each gantry they pass under. 

Otto Lies of Holden said he often has relatives visit from out of state, and asked why they should have to pay what could amount to a few dollars more per trip for not going through the work of getting a free E-ZPass transponder. He said he didn't have a problem with the mailing fee, or perhaps even a single levy of the 30-cent gantry fee.

"a Town Council is like having Town Meeting twice a month"

The Milford Daily News reports on some area communities that have changed from a town meeting to a manager and elected council to govern.

Franklin Town Administrator Jeffrey D. Nutting said many Bay State communities are still wrestling with "the never-ending debate over choosing between giving people a direct voice or governmental efficiency.'' 

Since revising its charter in 2010, Franklin is governed by nine Town Council members and an administrator whom they appoint. 

"When communities debate this you always hear people's concern about losing their representative voices. The love of town meeting is an emotional issue. People say it's the purest form of democracy,'' he said. "But towns can't be run like they were 200 years ago. I just see the world is changing and I think this is the best way to deal with it.'' 

For Nutting, working in concert with Town Council has helped Franklin move quickly to offer businesses tax incentives to move to town, fine tune zoning changes and resolve unexpected problems.

In the News - Treasurer to remained elected, voice heard

"It was nice to see (the questions) on there, giving us the choice. In the case of treasurer, it's right to make it an appointed position," Tierney said.

Others were left feeling confused by the questions.

"I didn't really understand it," said Clare Flynn.

In an election that embodied several local and statewide races, James Lacroix yesterday said it was Question 3 that lured him to the polls.

The Franklin resident said he voted to reduce the sales tax to 3 percent.

"We need to learn how to use the money more efficiently and do what we need to do instead of spending it wastefully," Lacroix said.
