FM #348 Board of Health Mtg - 9/16/20 (audio)

FM #348 = This is the Franklin Matters radio show, number 348 in the series.


This session shares the Board of Health meeting held on Wednesday, Sep 16, 2020. The meeting was conducted via conference bridge to adhere to the ‘social distancing’ requirements of this pandemic period.


Chair Bridget Sweet opened the meeting and reviewed the usual protocol for conduct of such remote meetings. 


Recap: 

  • The Board of Health met to review and revise the penalty order they had approved at their Sep 2 meeting. Feedback from Town Attorney Mark Cerel led to the revision. The revision was approved by a 3-0 vote. As soon as the order is available, the link will be shared.

Board of Health Meeting Recap - Sep 16, 2020

The Board of Health met on Wednesday to review and revise the penalty order they had approved at their Sep 2 meeting. Feedback from Town Attorney Mark Cerel led to the revision. The revision was approved by a 3-0. As soon as the order is available, the link will be shared.

  • Education is the primary tool, not wanting to use penalties - only as a last resort. They have been getting multiple requests from same place. #BoH0916 motion to withdraw motion on 9/02/20 on penalty provisions; passed 3-0 via roll call
  • Motion for revision proposed for fine where social distance is not possible, second, passed 3-0 via roll call. Motion amended to be effective Thursday 9/17/20 end of day. Passed 3-0 via roll call. #BoH0916
  • First cluster found in a business in Franklin. Regroup of the Board to review/revise penalty process as devised in prior meeting. #BoH0916 should it be considered to include parties for residential areas as well as business entities. Limit to face coverings as those as frequent
  • Discussion on keeping meeting virtual as long as possible, many have high risk family members. Want to avoid unnecessary contact. #BoH0916 meetings are still functioning well in the remote mode. Meeting adjourned with roll call vote

Board of Health Recap - Sep 2, 2020

Recap: The Franklin, MA Board of Health discussed and approved a tiered penalty structure for violations of COVID-19 emergency order to be effective Sep 8, 2020.

The interns presented the plan for distribution of the flu shots and potentially for the coronavirus vaccine. Workflow, materiel order sheets, workstation supply sheets, etc. It seems comprehensive. Copy not available other than via screen captures during the meeting. 

Some other items of business were reviewed briefly before the meeting closed with kudos to the interns for their work on the planning.

Strategic Materials fined for violating state air pollution control and wetland protection regulations

"The Massachusetts Department of Environmental Protection (MassDEP) has assessed a $17,200 penalty on Strategic Materials, Inc. of Houston, Texas, which operates a glass recycling facility at Kenwood Circle in Franklin, for violating state air pollution control and wetland protection regulations.

Strategic Materials holds an air quality permit issued by MassDEP, which establishes emission limits and operating requirements for the glass bottle-crushing facility. Inspections conducted by MassDEP staff in 2014 identified violations of both the permit and the Wetlands Protection Act regulations."

Individual mandate penalties proposed for tax year 2011

The Department of Revenue has posted the proposed 2011 penalty schedule for those who are able to afford the purchase of health insurance but fail to do so. The Massachusetts Health Care Reform Act of 2006 requires most adults 18 and over with access to affordable insurance to obtain it, and requires DOR to announce a penalty schedule for individuals who do not comply with the law.

The penalties for individuals between 150.1 percent and 300 percent of Federal Poverty Level (FPL) are equal to half the cost of the lowest priced Commonwealth Care enrollee premium as of Jan. 1, 2011.

For those between 150.1 percent and 300 percent of FPL (up to $32,496 for an individual or $66,156 for a family of four) the annual proposed penalty is unchanged from last year. For example, an individual who is between 250.1 percent and 300 percent of FPL paid a maximum penalty of $58 a month ($696 annually) in tax year 2010 and is proposed to pay the same penalty in tax year 2011. The same penalty is proposed for a family of four with earnings not in excess of $66,156; however, the penalty is multiplied by two if both parents are uninsured.
Individuals with incomes up to 150 percent of FPL (or less than $16,248) are not subject to the penalty and are not required to pay an enrollee premium for Commonwealth Care health insurance. Neither is a family of four whose income does not exceed $33,084.

For those ages 18-26 whose income exceeds $32,496 or 300 percent of FPL, the penalty for tax year 2011 is proposed to equal to half of the lowest priced individual Commonwealth Choice Young Adult Plan premium without drug coverage or $72 per month ($864 annually), up from $66 per month ($792 annually) in tax year 2010.

For those ages 27 and older whose income exceeds 300 percent of FPL, the proposed penalty is equal to half of the lowest priced individual Commonwealth Choice Bronze premium with drug coverage or $101 per month ($1,212 annually), up from $93 per month ($1,116 annually) in tax year 2010. Again, this penalty is multiplied by two if two parents are in the family.
