Shedding Light on Solar Panel Contracts

As Massachusetts continues to embrace green energy and homeowners increasingly consider solar panel installations, Norfolk County Register of Deeds William P. O’Donnell reminds consumers to thoroughly review the terms of their solar energy contract before signing.

“The growth of solar energy in Massachusetts is undoubtedly a positive step towards a sustainable future,” stated Norfolk County Register of Deeds William P. O’Donnell. “However, with this comes a heightened responsibility for homeowners to be diligent. While the cost of solar installation has significantly decreased over the past decade and a half, a system can still represent a substantial investment, often ranging from $18,000 to $30,000, and contracts can span two decades.”

Register O'Donnell highlighted a specific concern that often catches homeowners off guard: the filing of a Uniform Commercial Code 1 Statement (UCC-1) by solar companies.

“Many consumers are unaware that after signing a financing contract, a UCC-1 can be filed with the Registry of Deeds by the solar company without the homeowner's signature,” Register O'Donnell explained. “This effectively places an encumbrance on your home, similar to a lien, and it can only be discharged once your final payment is made. Unlike a mortgage, which requires the homeowner's explicit signature, a UCC-1 can be filed unilaterally by the company, making it easy for its existence to go unnoticed.”

Due to the presence of a UCC-1 encumbrance from solar panel agreements, homeowners might encounter difficulties or need to undertake additional steps when applying for home equity loans or reverse mortgages. Beyond challenges with refinancing or securing equity, homeowners with solar panel agreements can also face significant hurdles when it comes time to sell their property.

“There's a common misconception that the solar panel contract will simply roll over to the new owner. This is not always the case. If the buyer isn't approved by the solar company according to the terms of some contracts, the current homeowner may be forced to purchase the solar panels and equipment outright before they can sell their property,” stated Register O'Donnell.

In light of these complexities, Register O'Donnell strongly advised homeowners to seek professional legal counsel. “Whether you choose to lease or purchase your solar panel system, there are numerous intricate details within these contracts that demand careful attention,” he urged. “This is a major financial transaction, and I cannot stress enough the importance of having a licensed attorney review the contract before you sign on the dotted line. The devil truly is in the details, and legal review can save you significant headaches and financial strain down the road.”

Register O'Donnell concluded. “As the proverb states, 'Forearmed is to be forewarned.' I strongly recommend that any homeowner seriously considering solar panel installation visit the Massachusetts Attorney General’s Frequently Asked Questions About Solar Products for Customers page on their website.”

Starting Monday, Aug 4, 2025 : Franklin/Foxboro Line service change due to Amtrak infrastructure repair work

The Franklin/Foxboro line will experience service and schedule changes due to Amtrak infrastructure repair work. 

Passengers can expect delays up to 20 minutes in both directions. 
  • On weekdays, after 9 AM, shuttle buses will replace service between Forge Park/495 and Franklin 
  • Foxboro trains 1770 and 1765 will have shuttle buses replace service between Walpole and Foxboro
  • Times with a B in Brown indicate the shuttle bus schedule

Annual Town Report Of The Town Clerk’s Office - FY 2024

With the Biennial Election coming up November 4, 2025, the nomination papers are available beginning today (Aug 4, 2025) for candidates to take, obtain the appropriate number of signations to get on the ballot. We are sharing the section of the Annual Report for the Town of Franklin 2024 to help explain what each role entails. The first up is that of the Town Clerk.

The obligations of the Town Clerk’s Office have changed dramatically over the last few years. I am very proud of the ability of my staff to adjust to the ever-changing requirements and needs of the public and their continuing ability to provide superior service to the residents of the Town of Franklin.

There will be many changes in the upcoming year. The Office of Vital Records and Statistics will be updating their very archaic software system. The Commonwealth of Massachusetts Voter Registration System is also updating their software as well, and if that’s not enough The Town of Franklin is also updating the Town’s Website and Accounting System Software. Seems like it’s the year of system updates.

I for one am thankful that this is all happening after the Presidential Election.

We are looking forward to learning the new systems and we are ecstatic to hear of the many positive changes coming to our Vital Records and Voter Registration software.

The ability of this office to successfully implement these new changes while also to provide for the needs of our constituents is a testament to the professional abilities of my office.

HISTORY TOWN CLERK OFFICE
“The office of town clerk is probably one of the oldest in municipal government. It appears in the Bible in the Book of Acts, Chapter 19, and verse 35 written in A.D. 58. A search of other early written records would no doubt reveal other instances in which mention of this office appears. In Massachusetts, town clerk was one of the earliest offices established in colonial towns although the title itself may not appear in the earliest records. The settlers were well aware of the importance of keeping accurate written records of their agreements and actions including grants of land, regulations governing animals, the collection of taxes and the expenditure of town funds. If your town records date back to the first half of the 17th century, you will probably find that a person was given the specific duty of writing down town orders and will see many entries in the record which include the words “It is ordered by the inhabitants,” or some similar words. Indeed, in Massachusetts, the town clerk was one of the earliest offices established in colonial towns.”

Our online service continues to be a success!! This has been a convenient way for the public to request and purchase birth, death and marriage certificates. This improvement has also been a great success for our dog owners who need to license a new dog or renew their yearly dog license. These document requests and payment options are available online anytime of the day, 7 days a week. To use this service, visit the town website at franklinma.gov/townclerk.

NOTARY SERVICE
The Town Clerk’s office provides Notary services as a courtesy. Residents seeking Notary Services should call the Town Clerk’s office prior to their visit to ensure that the Notary is available. The following guidelines will be followed in the provision of Notary Service: - Notary Services are available during the normal business hours. Notary Service is provided on a first-come, first service basis. Please be sure to have valid government-issued photo ID if you are seeking this service. Remember, the document must be signed in the presence of the Notary. Notary Service is not available for deeds, mortgages, wills, living wills, living trusts, power of attorneys, or depositions. Certain public documents cannot be copied and notarized. For more information please visit our website. The Town Clerk, Nancy Danello, and Deputy Town Clerk, Dyan Fitzgerald are also Commissioners to qualify, which means if you are a Notary Public or a Justice of the Peace and need to be given the “Oath of Office” we can perform this service for you free of charge.

Survey says: "Nearly all of the fire departments in Massachusetts do not meet national staffing standards"

"Nearly all of the fire departments in Massachusetts do not meet national staffing standards, according to a survey conducted by the state fire union in the wake of the deadly fire at a Fall River assisted living facility. 

.... 

Per standards set by the National Fire Protection Association, fire engines or ladder trucks should each be staffed with a minimum four on-duty members. In Massachusetts, the average number of firefighters on an engine is less than 2.5 firefighters and the average responding on a ladder is less than two, according to the survey.”

In Franklin, we want to be transparent about our current staffing levels and how they compare to national guidelines set by the NFPA (National Fire Protection Association).

Our minimum on-duty staffing is 11 personnel per shift, broken down as follows:
 • Engine 1: 1 Lieutenant, 2 Firefighters
 • Engine 2: 1 Captain, 2 Firefighters
 • Ambulance 1: 2 Firefighter/Paramedics
 • Ambulance 2: 2 Firefighter/Paramedics
 • Battalion 1: 1 Battalion Chief
Tower 1 is cross-staffed with Ambulance 1, meaning the same 2  Firefighter/Paramedics will respond in Tower 1 only if they are available and in the station. As call volume continues to rise year after year, Tower 1 is increasingly out of service when needed most.

According to NFPA 1710, fire departments in low call-volume areas should staff a minimum of 4 firefighters per apparatus, with that number increasing to 5 or 6 in high-volume or densely populated communities.

Despite these challenges, we remain committed to providing excellent care and emergency service to the Franklin community. We are proud of the work we do, and proud to serve.

The walkout was a sharp escalation in the bitter partisan clash over a mid-decade redistricting in Texas that was requested by President Trump. Republicans in the State Legislature were rapidly moving forward, with the map — drawn to flip five Democratic congressional districts to favor Republicans — being passed out of two committees over the weekend.

Hours after the Democrats departed, Gov. Greg Abbott responded with a further escalation, declaring that their walkout amounted to an “abandonment or forfeiture of an elected state office.”

Franklin TV: What’s Left?

A casual conversation, overheard:
“I ‘member when y’ could ack-shly bang a left out o’ Hunnydoo Donitz.”

The group holding court in the corner were referring to the increasingly heavy –
and increasingly frustrating – traffic along Franklin’s main drag – Route 140.

“Yeh. You got that right. Ain’t like it usta be – wikkid busy these days.“

Behind the wheel, most of us suffer in silence. Then there are those who refuse to suffer so silently. They’re quick to lean on that horn over any and every thing.
Their car horn becomes weaponized.

Conversely, there are some who struggle to drive. They’re acutely hyper-cautious.
It’s all dangerous. Leaning on the horn from behind? Not helpful.

Standing at a corner, I witnessed one driver ‘of a certain age’ carefully preparing to negotiate a left turn. He rolled slowly, almost to a stop. The driver behind him wasn’t having it, and repeatedly hit the horn.
“What’s it take just to negotiate a left turn? You need a negotiating team.?  Turn already.”
More impatient honking – and yelling.
“Just take the turn, old man. Why are you even on the road?”
The cautious driver had started turning, then abruptly stopped – got out –
calmly walked back to the honker/screamer behind him. He said,

“I was turning – when all the honking distracted me – and yes, I froze. 
Consider, sir, that someday, if you are fortunate enough to live long enough – and to drive long enough – this – will be your turn. 
And, in turn – I hope that whoever is behind you is more considerate – more patient.”
Absent simple turns of kindness, what’s left?
