Register O’Donnell Provides Update on Mortgage Transparency Legislation

Norfolk County Register of Deeds William P. O’Donnell announced today (Friday, Feb 21, 2020) that legislation, House Bill 1413 accompanied by Senate Bill 960, that would promote mortgage transparency for consumers, has been referred to the House Committee on Bills in the Third Reading for review.

“The impact of this legislation,” noted the Register, “guarantees that a homeowner would know when a third party has been assigned their residential mortgage (usually sold by one financial institution to another), since the legislation requires the mortgage assignment to be recorded at the appropriate Registry of Deeds office within 30 days of the transaction.”

Additionally, consumers looking to record a mortgage discharge and those facing foreclosure would benefit as the legislation provides a permanent source of reference for the homeowner. They could even view the transaction online via the relevant Registry of Deeds website. Register O’Donnell has been a strong supporter of the legislation and has twice testified on its merits before the legislature’s Joint Committee on the Judiciary.

“This legislation levels the playing field as it requires the larger lending institutions who in the past have not recorded assignments to do so just as the smaller local community banks have been doing all along,” noted O’Donnell.

“I am hopeful the House Committee on Bills in the Third Reading will report the legislation favorably to the floor of the House of Representatives for consideration. This legislation benefits homeowners across Massachusetts, since it will eliminate uncertainty as to which lending institution is the mortgage holder of record,” concluded Register O’Donnell.

Register O’Donnell Reports on January 2020 Norfolk County Real Estate Activity

A strong local economy and continuing low interest rates have resulted in a robust January Norfolk County real estate market, according to Register of Deeds William P. O’Donnell.

Register O’Donnell stated, “During the month of January, real estate sales, for both residential and commercial property, rose by 11% from the previous year. A total of 1,261 property transactions were recorded versus 1,141 in January 2019. This increase was all the more impressive when one considers the continuing challenges facing the real estate market due to limited amount of inventory for sale.”

According to January statistics, the average combined sale price of residential and commercial property for the month was $900,864, a 36% increase year over year. In addition, total dollar sales volume, again for both residential and commercial properties, was $636 million, a 47% increase from January of 2019. “These numbers,” noted Register O’Donnell, “were impacted by a $50 million commercial sale recorded during the month in Brookline.”

Norfolk County lending numbers, again fueled by low interest rates, showed a large increase during the month of January. The Register noted, “The number of mortgages recorded during the month increased by 64%. Also, the total volume of mortgage financing, for both residential and commercial properties, came in at $1.2 billion, a 98% increase year over year. There can be no doubt consumers and businesses both are continuing to take advantage of low interest rates.”

However, a definite concern was in the area of foreclosure activity. “During January,” noted the Register, “there were 15 foreclosure deeds filed compared to 12 during the same time period in 2019. Also, there was a 36% increase in the number of Notice to Foreclose Mortgage filings, the first step in the foreclosure process.”

“The foreclosure numbers seen in January are a stark reminder that while the local economy remains strong, some of our neighbors are having trouble paying their mortgage. I want to remind Norfolk County residents that my office continues to partner with the Quincy Community Action Programs, 617-479-8181 x376, and NeighborWorks Housing Solutions, 508-587-0950. These organizations can help homeowners who have received a Notice to Foreclose Mortgage document. A third option is to contact the Massachusetts Attorney General’s Consumer Advocacy and Response Division (CARD) at 617-727-8400.”

On the consumer front, the number of Homestead recordings also increased during January. A total of 842 Homesteads were filed compared to 757 in January 2019. O’Donnell noted, “A Homestead provides limited protection against the forced sale of an individual’s primary residence to satisfy unsecured debt up to $500,000. I urge homeowners to review the possibility of taking advantage of the Homestead law.”

Register O’Donnell concluded, “The data we have seen for Norfolk County is reinforced by what we are hearing from both real estate agents and mortgage loan officers. The low real estate inventory has led to bidding wars, where in some cases, properties are being sold above the original asking price. It is the industry’s belief that average real estate sales price should remain high until there is a substantial increase in inventory, something we do not see happening in the near future.”

Dedham recently approved a temporary moratorium on new mixed-use development projects; Saugus instituted a moratorium on multifamily dwellings; and Arlington recently delayed action on zoning proposals that would ease restrictions to promote housing growth. 
“Like many cities and towns, there is a concern about growth and the ability to absorb that growth, whether it’s traffic, schools, or the infrastructure,’’ said Dedham Town Planner Jeremy Rosenberger. 
Multifamily housing accounted for nearly all new housing permits issued in Suffolk County between 2000 and 2017, and the majority in Middlesex and Norfolk counties, according to a recent report by the Boston Foundation. Single-family housing continued to predominate in Essex and Plymouth counties."

Norfolk County Register of Deeds William P. O'Donnell reported that 2nd quarter (April-June 2019) real estate statistics showed a slight decrease in residential and commercial sales, while mortgage lending numbers experienced a small uptick and foreclosures were way down.

Register O'Donnell noted, "The 2nd quarter figures showed an overall 1% reduction in the number of properties sold countywide from 4,971 to 4,918 for the same quarter of 2018. The flat real estate sales tell us there are still challenges when it comes to real estate inventory. It has been an ongoing issue and one that certainly needs to be watched closely."
Register O'Donnell further stated, "The recently concluded 2nd quarter also saw the average Norfolk County real estate sales price, for both residential and commercial properties, decrease 11% to $776,889. Total dollar real estate volume, again for both residential and commercial, was $2.4 billion, a 16% decline year over year. These figures were impacted by the $177 million sale of Steward Norwood Hospital that took place on 6/28/18."

For the 2nd quarter 2019, the number of land documents recorded, (such as deeds, mortgages, Homesteads, mortgage discharges, etc.) was 37,019, a slight 1% drop-off from the previous year. Register O'Donnell noted, "This relatively flat figure tells us we have a ways to go before we see robust growth in the real estate market."

One good piece of positive news was the 7,108 mortgages recorded at the Registry in the 2nd quarter compared to 6,826 for the same time period in 2018. Additionally, total mortgage borrowing was $3.8 billion for the second quarter compared to $4 billion during the 2nd quarter 2018. "With the reduction in interest rates, consumers seem to be more comfortable when it comes to borrowing money," stated the Register.

Norfolk County homeowners continued to benefit from the Homestead Act. A total of 3,396 Homesteads were recorded during the 2nd quarter, a 1% increase year over year. "The Homestead law provides limited protection against the forced sale of an individual's primary residence to satisfy unsecured debt up to $500,000. I urge Norfolk County residents to consider this important consumer protection tool," noted O'Donnell.

Foreclosure activity in Norfolk County continued to show signs of improvement. A total of 27 foreclosure deeds were recorded versus 48 filed during the 2nd quarter of 2018. In addition, there was a significant 38% drop in the number of Notice to Foreclose Mortgage recordings, the first step in the foreclosure process.

O'Donnell stated, "One foreclosure is one too many, and while the eastern Massachusetts economy remains on a solid footing, there are still those in Norfolk County experiencing economic hardships. The Registry continues to work with Quincy Community Action Programs, (617-479-8181 x376), and NeighborWorks Housing Solutions, (508-587-0950) to help homeowners who have received a Notice to Foreclose Mortgage document. A third option is to contact the Massachusetts Attorney General's Consumer Advocacy and Response Division (CARD) at 617-727-8400."

Register O'Donnell concluded, "While real estate sales were mostly flat during the recently concluded quarter, a cause for optimism was the uptick in lending numbers. A continuing strong economy in eastern Massachusetts, and the possibility of further interest rate cuts as signaled by Federal Reserve Chairman Jerome Powell to congressional committees, should bode well for the overall real estate market going forward."

Register O'Donnell Reports Real Estate Activity off to a Slow Start in 2019

Register of Deeds William P. O'Donnell reported an across-the-board decline in real estate activity for Norfolk County in January 2019. Declines were seen in both real estate sales and in mortgage lending.

"During the month of January, a total of 1,141 residential and commercial real estate sales were recorded countywide, resulting in a 7% drop from the previous January numbers. Additionally, the total dollar volume of these residential and commercial sales decreased by 42% to $433.7 million year over year, as well as declined in the average sale price by 39% to $662,165. The reductions in total sales numbers and average sales price were skewed by two Quincy commercial sales, one for $80 million and the other for $43 million that took place in January 2018," noted the Register.

Lending activity continued to experience declines in January. A total of 1,463 mortgages were filed in January, a 21% reduction from the previous year, along with a 54% decline to $653.9 million for total mortgage recordings. Register O'Donnell stated, "Norfolk County homeowners continue to be very cautious when contemplating whether or nor to borrow money. Factors include decreased mortgage activity caused by lack of available real estate inventory, concern about the direction of mortgage rates and the uncertainty about the state of affairs in Washington D.C."

One notable bright spot was the sizeable reduction in Norfolk County foreclosure activity. Foreclosure deed recordings fell 33% for January. The news was even better for Notice to Foreclose Mortgage filings, the first step in the foreclosure process, which declined by a whopping 43%. Register O'Donnell noted, "The foreclosure stats were very encouraging for January. Of course, this is small consolation to those homeowners who are having difficulty paying their mortgage due to economic hardship."

The Norfolk County Registry of Deeds continues to partner with Quincy Community Action Programs, 617-479-8181 x-376, and NeighborWorks Southern Mass, 508-587-0950. They are available to help anyone who has received a Notice to Foreclose Mortgage from a lender. A third option is to contact the Massachusetts Attorney General's Consumer Advocacy and Response Division (CARD) at 617-727-8400. Each of these programs is staffed by knowledgeable professionals. Anyone who has received a foreclosure notice should consider availing themselves of these excellent programs.

On the consumer protection front, the number of Homestead recordings fell 4% in January from 757 compared to 791 year over year. "A Homestead," stated O'Donnell, "provides limited protection against the forced sale of an individual's primary residence to satisfy unsecured debt up to $500,000. I urge homeowners who have not recorded a Homestead to consider this valuable consumer protection tool."

In conclusion, Register O'Donnell stated, "Without question January was a disappointing month for real estate activity in Norfolk County. Traditionally, winter months like January do not exhibit great real estate numbers. Lack of available inventory continues to be a serious issue. This shortage of housing stock is especially impacting first-time home buyers. While the Federal Reserve has indicated a willingness to reduce the number of interest rate increases, consumers are still being cautious when it comes to borrowing money. Hopefully, we will see improvements in the real estate climate going forward."

While the eastern Massachusetts economy remained strong during 2018, the Norfolk County real estate market continued to experience mixed results when it came to sales and mortgage lending activity.

Register of Deeds William P. O'Donnell noted, "A yearly review of 2018 real estate activity in Norfolk County showed a total of 18,124 residential and commercial real estate sales transactions. This represented a 2% decrease from 2017. However, the volume of residential and commercial total dollar sales increased by 19% last year. The average sales, again both residential and commercial, was $841,414, an increase of 22% from the previous year."

The Register noted that there was an 8% reduction in the number of land documents recorded at the Registry in 2018 with a total of 141,159 compared to 152,927 in 2017. "A key factor in the overall decrease in land documents recorded," noted O'Donnell, "stemmed from the reduced number of mortgages filed at the Registry. A total of 24,503 mortgages were recorded in 2018, representing an 11% decrease from 2017. Also, total mortgage financing closed at $17.7 billion, a 6% decrease from the previous year."

In 2018 on the consumer front, Norfolk County residents continued to avail themselves of the protections provided by the Homestead Act. A total of 12,102 Homesteads were recorded, resulting in a 4% decrease from 2017. O'Donnell reiterated the importance of having Homestead protection. "A Homestead provides limited protection against the forced sale of an individual's primary residence to satisfy unsecured debt up to $500,000. I urge homeowners who have not already recorded a Homestead against their primary residence to consider this valuable consumer protection tool."

Foreclosure activity saw some improving signs. A total of 221 foreclosure deeds were filed in Norfolk County during 2018 compared to 268 in the previous year, an 18% decrease. Additionally, Notice to Foreclose Mortgage, the first step in the foreclosure process, also decreased by 10.9% during the same period. "I am pleased that reduced foreclosure activity was seen in Norfolk County during 2018. With that said, we must always remember that some of our neighbors will experience economic hardship and will need assistance," noted the Register.

To help those experiencing challenges paying their mortgage, the Registry continues to work in partnership with Quincy Community Action Programs, 617-479-8181 x376, and NeighborWorks Southern Mass, 508-587-0950. These organizations are equipped to help homeowners who have received a Notice to Foreclose Mortgage document. Register O'Donnell concluded, "As we start 2019, the major real estate stories continue to be housing inventory and interest rates. However, there is good news. Due to market forces, mortgage interest rates are now at their lowest levels in 8 months fueling hopes that more people will soon enter the lending market to refinance or buy their first home. However, a move by the Federal Reserve to once again increase rates would certainly cause some consumers to pause about buying big ticket items."

Mirroring trends seen across eastern Massachusetts, Norfolk County real estate is continuing to experience sluggish sales due to limited inventory of available properties, according to Register of Deeds William P. O'Donnell.

Register O'Donnell noted, "During the month of November, real estate sales, for both residential and commercial activity, fell 2% from the previous year. A total of 1,476 property transactions were recorded versus 1,512 in November 2017. The bottom line is you can't sell more of what you don't have."

According to last month's statistics, the average combined sale price of residential and commercial property for the month was $936,750, a 47% increase year over year. In addition, total dollar sales volume, again for both residential and commercial properties, was $911 million, also a 47% increase from November 2017. These numbers were greatly spiked by a $153 million commercial sale recorded in Brookline.

On the financial side, Norfolk County lending numbers were mixed during the month of November. The Register noted, "The number of mortgages recorded during the month decreased by 16%. However, the total volume of mortgage financing, for both residential and commercial properties, came in at $1.2 billion, a 3% increase year over year. There can be no doubt consumers are being prudent when considering big ticket expenses due to increases in the interest rates."

While the figures were mixed, there are some definite reasons for optimism when it comes to foreclosure activity. "First the bad news," noted the Register, "there were 17 foreclosure deeds filed in November compared to 13 during the same time period in 2017. The good news; during the same time period there was a 68% reduction in the number of Notice to Foreclose Mortgage filings, the first step in the foreclosure process."

"The Notice to Foreclose Mortgage numbers were really encouraging," stated Register O'Donnell. "With that said, we need to remember that foreclosure activity has a human face. I want to remind Norfolk County residents that my office continues to partner with the Quincy Community Action Programs, 617-479-8181 x376, and NeighborWorks Southern Mass, 508-587-0950. These organizations can help homeowners who have received a Notice to Foreclose Mortgage document. A third option is to contact the Massachusetts Attorney General's Consumer Advocacy and Response Division (CARD) at 617-727-8400."

Register O'Donnell Reports Mixed Real Estate Results for January

Register of Deeds William P. O'Donnell reported mixed Norfolk County real estate results for January, 2018. The Register noted that while the total real estate sales volume and average sales price showed increases, mortgage lending activity continues to decline in what has become a challenging market.

During the month of January 2018, a total of 1,228 residential and commercial real estate sales were recorded countywide, resulting in a 6% reduction from the previous January numbers. However, the total dollar volume of these residential and commercial real estate sales increased 41% to $750 million year over year. The average sale price, again including both residential and commercial, also increased 59% coming in at $1,077,669. "These numbers," noted O'Donnell, "were impacted by two Quincy commercial real estate sales, one for $80 million and the other for $43 million."

Continuing a trend from the past several months, lending activity experienced a decline. A total of 1,853 mortgages were recorded in January, a 19% reduction from the previous year. Register O'Donnell stated, "There is no question Norfolk County consumers continue to be very cautious when contemplating borrowing money to pay for big ticket items such as home improvements and higher education costs," In addition, total mortgage lending in January decreased by 20% to $1.4 billion from the January of 2017.

Norfolk County foreclosure activity was a mixed bag. The good news was a 40% reduction in the number of foreclosure deeds recorded; 18 were recorded in January compared to 30 in January, 2017. The discouraging news was a total of 67 Notice to Foreclose Mortgages, the first step in the foreclosure process, were filed during the month compared to only 41 year over year. This represented a disturbing 63% increase.

Register O'Donnell noted, "While the economic climate in eastern Massachusetts remains strong, there are some property homeowners who are facing economic challenges, many through no fault of their own. As Register, I am very proud of the Norfolk County Registry of Deeds partnership with Quincy Community Action Programs, 617-479-8181 x-376, and NeighborWorks Southern Mass, 508-587-0950. They are available to help anyone who has received a Notice to Foreclose Mortgage from a lender. A third option is to contact the Massachusetts Attorney General's Consumer Advocacy and Response Division (CARD) at 617-727-8400. Each of these programs is staffed by committed and knowledgeable professionals. I urge anyone who is facing a foreclosure issue to avail themselves of these excellent programs."

On the consumer front, the number of Homestead recordings also fell in January. A total of 791 Homesteads were recorded compared to 902 in January 2017. "A Homestead," stated O'Donnell, "provides limited protection against the forced sale of an individual's primary residence to satisfy unsecured debt up to $500,000. I urge homeowners who have not recorded a Homestead against their primary residence to consider this valuable consumer protection tool."

In conclusion, Register O'Donnell stated, "There is no question we are continuing to see a slowdown in the Norfolk County real estate market. A lack of available real estate inventory continues to have a negative impact on the market. This lack of inventory, and consumers continued caution when contemplating borrowing money, is also causing a corresponding slowdown in the lending market. Until we see an uptick in available real estate inventory, these trends are more than likely to continue."
