LEGAL NOTICE - FRANKLIN, MA

The Franklin Town Council will hold a second reading and take a final vote on the adoption of Bylaw Amendment 22-883:
Chapter 179 §179-9.1. Water System Map Exhibit A (Map): be amended by adding as an eligible location the following:
§ 179-9.1 Water System Map.
Exhibit A: Extending a water service line from 20 Ridgeview Road for a single water service connection to the existing main on Old Farm Road.

This bylaw amendment shall not become effective until all conditions agreed to between the property owner and the Franklin DPW are satisfied.

This action will take place during the Town Council’s public meeting on September 7, 2022, beginning at 7:00 PM and will provide an opportunity for public input. Location: Municipal Building, 2nd floor Council Chambers, 355 E. Central Street, Franklin, and also via the “ZOOM” platform. Residents can visit the Town website (Franklinma.gov) town calendar to review the proposed bylaw amendment, including the proposed map, and for up to date meeting information, on and after September 2, 2022. Please call the Town Administrator’s Office at (508) 520-4949 if you require further information or to make arrangements for translation services.

In accordance with the Town of Franklin Zoning By-Laws, the Franklin Planning Board will hold a public hearing at the Town Hall (and can also be attended remotely) on Monday, August 8, 2022 at 7:05 PM in the Town Council Chambers of the Franklin Municipal Building, 355 East Central Street, for a Site Plan application titled “Proposed Child Day Care Facility” Franklin, MA prepared by Joshua Kline, Salem, MA., and submitted to the Department of Planning & Community Development on July 6, 2022, by Primrose School Franchising Company, Warren, NJ.
The property is located in the Commercial II Zoning District (Assessors Map 303 Lots 46 & 47) at 700-712 Union Street. The Applicant is proposing to construct a one-story child day care facility with off-street parking, landscaping, utility services, site lighting and stormwater management facilities.
Please note: This will be your only written notice of this public hearing. Should the Planning
Board vote to continue this Public Hearing, the date and time will be posted on the Planning
Board’s website under Agendas.

Notice Of Public Hearing - May 4, 2022

The Franklin Town Council will hold a public hearing to determine whether it is in the public interest to accept Joseph Circle, including two parcels with frontage on Beech St., Susan's Way, including two parcels with frontage on King St., and a portion of Lawrence Drive as public ways. 
This hearing will be held during the Town Council Meeting at 7:00 pm on May 4, 2022 and will provide an open forum for discussion. Location: Municipal Building, 2nd floor Council Chambers, 355 E. Central Street, Franklin, MA, and also via the “ZOOM” platform.

Recap: Board of Health approves change to septic bylaw, will look at mask requirements and encouraging vaccinations

Quick Recap:
  • Meeting in hybrid format, board members remote, staff and some public in person at Municipal building, other public also remote
  • Public hearing on change to septic regulations to better protect current and future homeowners from system failures.
  • State regulations had changed no longer permitting tanks sizes less than 1000; clarification on the need to replace is NOT due to this change but WHEN and if the system failed. 
  • After discussion change was approved. Health Director Cathleen Liberty to work on language to better explain the change and requirements.
  • Multiple other items of regular business conducted. Vaccine clinic for youth scheduled, nurse visits and action increasing; Winter St property being readied for demolition but actual permit not yet pulled;
  • Citizen comment on the lack of a mask mandate given the rise in COVID cases will bring about a meeting to review the topic and enforcement (which is really the key issue) before the regularly scheduled Feb meeting.

  • Opens public hearing on septic systems, #boh0105 looking to have title 5 changes certified by structural engineer/professional rather than putting the burden on the resident, also addresses smaller tanks previously allowed and not permitted now …

  • If tank is too small per state regs, a failure would require replacement, a state requirement.
  • State law calls for sewer connections if available where a septic system fails or is not feasible #boh0105
  • Existing 1000 gallon tanks would be replaced with 1500 per state requirement, #boh0105 this is not a town mandate, this curbs issues for home owners and buyers for future and brings better alignment with state alignment
  • Public hearing closed, motion to accept changed language, seconded, passes 3-0 via roll call. Motion to be effective 4/1/2022, seconded, asses via roll call. #boh0105 "user friendly language" to be circulated to board 4 review before publication
  • Moving to other agenda items; #boh0105 Winter st progress noted, awaiting demo permit; work underway, asbestos removed from siding. Report reviewed
  • Nurse Alecia providing updates; over 4k cases, 56 deaths, no home kit testing part of numbers, another clinic coming 1/19 at the Senior Center. Clinic scheduled for FHA #boh0105 Town has ordered test kits for local and 1st responders use, likely through Health Dept
  • Current supply for staff and families, new epidemiologist starting new week, full time here as part of Metacomet Shared Services.
  • Next up Cleveland Ave upgrade approval from board, agent did recommend, motion, second, passes via roll call #boh0105
  • No new business; public comment - Max - why the BoH hasn't been advocating local masking? Have generally been following the State, thought of regularly, enforcement is really the issue, who would? The BoH is not prepared to do so. #boh0105
  • Perhaps review a stronger advisory on masking and encouraging  vaccine effectiveness for Feb or sooner meeting? #boh0105 work by dept has been enormous, there are limits. The board will support the Dept however possible.
  • If something isn't always enforced doesn't always mean we don't have it. Motion to adjourn, seconded, passes 3-0 via roll call #boh0105

Recap: Community Preservation Committee opens first hearing how CPA funds should be used (audio)

Quick Recap:
  • First of two public hearings opened Tuesday, Jan 4, 2022. Residents made several suggestions for use of the CPA money to be available later this year. The second hearing is scheduled for Jan 18.
  • This is the first time the Town of Franklin is doing this process but it seems will be great opportunity for residents to get into the discussion on prioritization of what money goes where for which items; open space (i.e. Maple Hill - done), recreation (more pickleball courts were top item at hearing), preservation (Museum or Red Brick School previously mentioned as possible), or housing (needs for more housing and more affordable previously raised).
  • Town Administrator Jamie Hellen cautioned that the projects will need to layout to allow for Town personnel to handle them, they all can't be done at once. Part of the prioritization will be which project to be set, in which area of Town, and for which need to ensure some equitable distribution. An example, don't add more pickleball courts to King St as that would be the only location, spread them out around Town.

Community Preservation Act Public Hearings Set to Begin in January 2022

The new portal to accept ideas or applications for funding for Community Preservation is now open. As required by law, the Community Preservation Committee (CPC) is required to have one public hearing per year to hear input on how to allocate Community Preservation funds. The Franklin CPC has decided on two public sessions in January. 


The public hearing dates are:
1. January 4, 2022 at 7:00 PM in the Council Chambers in the Municipal Building at 355 East Central Street  Agenda = https://www.franklinma.gov/sites/g/files/vyhlif6896/f/agendas/2022-01-04_cpc_agenda_-_hearing_1.pdf

Citizens may attend in person, through Zoom, offer comments and opinions, ask questions or submit ideas for consideration in our new online portal. Hard copy applications are also available by contacting Alecia Alleyne in the Town Administrator's Office at 508-520-4949 or by emailing aalleyne@franklinma.gov.

The Application for Funding for the fiscal year 2023 (FY23) beginning July 1, 2022 must be received by 4:00 PM on Monday, February 28, 2022. After the first year of CPA funding, applications will be then taken on a rolling basis. 

Applicants should review the State CPA legislation prior to submitting any applications for CPA Funding. Please keep in mind that there are legal limitations on the use of CPA funds.

The Community Preservation Act (CPA) was passed in 2000 to help communities empower themselves to raise a dedicated revenue source for the purposes of open space preservation, historic preservation, affordable housing and recreation.

Recap: Community Preservation Committee approves meeting schedule, reviews sample plans/applications, sets Jan 4 and 18 as public hearings

Quick Recap:

  • A short 21 minute meeting saw the introduction of new member Rick Power. He will represent the Planning Board and was unable to vote until formally approved by the Town Council.
  • The proposed schedule of meetings for 2022 mostly Tuesday nights to avoid conflict with School Committee and other meetings in the Council Chambers was approved by 8-0 vote.
  • Discussion on sample plans and applications used by other communities. Watertown's plan and Concord's application were touted and generally received agreement to be used as the 'template' for the Franklin version
  • Public hearings scheduled for Jan 4 and Jan 18 to allow the community to provide input and suggestions to develop the 'wish list' for how the CPA funds can be used.

The meeting was conducted in a hybrid format: members of the Town Council and Town Administration personnel were in the Council Chambers, some members of the public participated in person, some via the Zoom conference bridge, all to adhere to the ‘social distancing’ requirements of this pandemic period.
