Town Council Meeting recap - 02/03/21 - town finances in great shape, storm water fee discussed, ambulance fee gets 1st approval

Quick Recap:
  • Scout leader Bill Murphy recognized for 30+ years of service for Troop 126
  • Valuable information in the presentation/discussion on Finance and borrowing. Town at great credit rate, recognition of fiscal management over the years
  • Difference between excluded borrowing and non-excluded borrowing explained. "Excluded" are those school building debt exclusions approved by voters. Over next several years only the new FHS will be left to pay for. Meanwhile, the "non-excluded" borrowing has paid for the Senior Center, fire stations, Library, etc. There is capacity for funding projects within the current operational budget for non-excluded projects over the next several years
  • Long impassioned discussion on the proposed storm water utility fee, not the last time for this discussion. For some councilors they appeared to have missed all the opportunities to participate in informational sessions as the proposal developed last year. Planning Board Chair took offence at not being included last year either
  • Ambulance fee increase approved for second reading. (Oh and one councilor who complained about 'death of thousand cuts' on the storm water fee approved this without raising a question)
  • Town ready to distribute vaccine to approved order of individuals but needs supply. Still supply/demand issue. Hope on horizon with possible increases in supply coming. Patience for now

Finance and borrowing presentation/discussion

  • Opportunity to leverage the debt funds to pay for the long term expenses i.e do the sewer interceptor without any additional funding. #tc0203 we are at AA+ only one step down from highest rating (AAA).

  • Non-excluded debt competes for interest expense in the ops budget, not so much an issue with number of projects, relates to the dollars associated with the projects and then with the interest for the bonds per project #tc0203
  • #tc0203 Bissanti not getting the dollar flow for the bonding, "rainbows and puppy dog tails", things change and they don't always change for the best. Stay within the budget so we can get the funding and maintain the rating.
  • Excluded debt comes from the prop 2 1/2 question and ballot choice, i.e. FHS the school required $100m of which the state reimbursed approx 60% so we bonded the 40% and that rolls off when done #tc0203 the rating is high due to the behavior of the Town Council in fiscal mgt
  • Kelly refuting the Bissanti comment, the town Council report card is AA+ hence we have been doing great. Are we about to change? I have no doubt future Council will do similar for our fiscal future. #tc0203
Storm water discussion

  • Pros/cons on the utility fee proposal #tc0203
  • We have the infrastructure that needs 2 be paid for, we either do it with the fee or taxes. #tc0203 Bissanti confused; the EPA and MA DEP, are government agencies not a private entity, Secretary level agency at the Governor's office. He's glad 2 hear that, was hearing otherwise
  • #tc0203 the utility fee provides for leeway (via exemption and credits) not available from property tax funding. Also the non-profits and state agencies pay the fee where they are exempt from the property taxes. How will credits work? List to be our together
  • Sidewalk and roads are part of town responsibility. The per 1000 SQ foot makes it easier to manage and calculate. Gravel road today is impervious. Could we change it? A choice to make. Where did the up to 50% come from? Why not a higher max? Majority of Communities do #tc0203
  • The end of the day, it goes back to the money raised for us to do the work. If x doesn't pay, someone else would. #tc0203 options to provide credits, etc. don't exist if property tax revenue is to be used. An ongoing discussion, not to be solved tonight.
  • Churches, non-profits are exempt from property taxes due to legislative decision. Attny Cerel chimes in on Q if legislative body could exempt them on this, apples to oranges; other municipality have enacted these, in MA also. Kelly argues that it is tax on commercial #tc0203
  • #tc0203 the utility is proposed because it is the most equitable way. The infrastructure here was put in over time and needs to be managed (paid for) we either do it this way equitably or via taxes, ultimate decision. The older building still needs to be covered with this code
  • #tc0203 from a Council side, I know we need the money, from a resident side they are going to be upset. We have a rebate program on rain barrel today. Can we get feedback on the MS4 permit? We need to push to get someone from the EPA to talk with us.
  • Kelly can go for a flat fee but not for an escalation fee. (Actually counter to what he said on the fiscal responsibility he talked of before) #tc0203 admits he is on soap box. Chair Mercer interjects that this only a discussion, moves on to another.
  • Not just about storm water, there are other things in the MS4 permit coming down the road, we are only talking about the implementation for the first phase. #tc0203 Padula disappointed if any Council member would vote for this. Planning Board was not asked to be part ...
  • Planning Board is the storm water manager per prior decision. #tc0203 this is the just the beginning. Putting salt into our water, and not cleaning catch basins so we are saving money. Now trying to generate more with this? Reconsider this
  • Chandler what happens if we don't do this? EPA thinks this is a palatable thing. There is not a lot of support for this, I get that. The requirements will increase year to year. If we don't do this fee, it will come from the tax revenue. And compete with other expenses #tc0203
  • Do we sacrifice other services? Or wait for the EPA to force and fine you. When, not sure but it will come. #tc0203 like OPEB, it needs to be funded, how are we going to do this. This will be on future agendas, it is a lengthy discussion.
  • The permit requires more than what we are already doing. So what we have been doing is in the budget. The question is where will the future come from. Tax or utility fee. #tc0203 the interest rate varies but one bonded remains the same. Future discussion, not any more tonight

  • Subcommittee reports: Budget, no meeting. Capital, not yet. EDC met just before this meeting, another listening session on food truck, craft brew bylaw. Report to be sent out on TA review prior to next subcommittee meeting. #tc0203
 Legislation for action

  • Motion to move to 2nd reading, majority required, via roll call 8-0-1 (1 absent) Town Administrator report, vaccine now, call BoH or Senior Center. We don't have doses available. #tc0203 we are preparing to deliver 100 to seniors over 75, supply/demand issue
Town Administrator report
  • FHS is an approved site, we are ready to go, we just need supply. #tc0203 the vaccine rollout is our #1 Economic Development effort, we are ready to go. It is frustrating not getting supply.   • #tc0203 we prepared to answer questions. If on listing, still working on the oldest and working back. 90+ for first round, only getting 100 doses. Looking at how many we can get? It is not just Franklin, everyone across the state has same issue
  • #tc0203 are you prepared for second lists to use all the doses? Yes, already covered. Even if it is one dose, we don't want to loose it. Budget calendar. Neutral for Town at this point with governor's release, probably early March for first view and hearings re: memorial day

CommonWealth Magazine: "Consider the potential of water utility jobs"

 

“WHEN I GROW UP, I want to be a wastewater operator.” That is probably not a commonly heard sentiment, but we think it should be, especially for our young people who have been historically marginalized.

When it comes to “green jobs,” typically it’s the clean energy industry – solar or offshore wind – that comes to mind. Yet there are thousands of good-paying jobs related to the delivery of clean water, disposal of wastewater, and management of stormwater. And right now there is a near-crisis as more people — generally older white men — are retiring from these water, wastewater, and stormwater jobs than are entering them. Retirement eligibility in the water utility world is estimated to be as high as 30 to 50 percent."

This session shares the Franklin, MA Town Council meeting held on Wednesday, Jan 20, 2021.

The meeting was conducted in a hybrid format: members of the Town Council, selected guests, and Town Administration personnel were in the Council Chambers, the public was remote via Zoom conference bridge, all to adhere to the ‘social distancing’ requirements of this pandemic period.

Franklin's "Watch list" for 2021

The "watch list" for Franklin in 2021. These are the items I see facing Franklin this year. The insights developed in over fourteen years of reporting on Franklin and in particular over 100 meetings during 2020 are behind the summary of items here. This is the short story. 

If you need or want more on these, stay tuned, I'll be following these throughout the year. If you want a better explanation of one or more, send me an email. If there are enough inquires, I can also schedule a Q&A session like held Thursday for the Senior Center.

Pandemic and recovery

  • This should not be a surprise, our individual health and the health of the community will begin to determine how much the economy can recover.

Town budget/School budget for FY 2022

  • While we averted a real problem last year, the question remains: what will happen this year? We get a peek with the release of the Governor's budget next week (by statue required by Wednesday). Given 22% of our budget is state aid (DLS numbers via DLS Dashboard), that is a key starting point.
  • The economy will help via the local receipts (assuming we recover from COVID-19). The School budget is the big unknown (from my point of view). The District is making progress on the Davis Thayer situation (but no timeline or approval yet on closing the building). While that is underway, the other buildings that could also be closed are not yet on the table for discussion.

Affordable housing

  • The population of Franklin has seen slower growth recently. What is the proper mix of housing for the population we have and anticipate? Will it be affordable for the folks to live here? All good questions and the discussion will be held in earnest this year.

Franklin election (November 2021)

  • Yes, the Town Council, School Committee, and many other positions are up for election in November. Who will run? What issues will they be facing? Will we see more youthful and diverse candidates?

Citizen engagement

  • The voter turnout for the Sep and November 2020 elections were the highest numbers seen although by percent, we have turned out more (in 2016). The pandemic likely contributed to both the voter numbers and smaller per cent. Mail ballots were a key contributor. Will they become the 'norm'? What about early voting for a local election?
  • The access to public meetings has made more engagement possible. Franklin residents can participate via Zoom, live stream, or cable channel. Less of an excuse to not be able to see and hear what is going on whether Town Council, Planning Board, School Committee or any number of other public boards and committees.

Finance Committee - Jan 13, 2021 - meeting recap = storm water utility fee and COVID-19 updates

  • Curious to see what the credits will look like; in particular, in my own case, to see what the approved pervious pavers would be. I was to redo my driveway and to get a way from blacktop might be doable.
  • COVID-19 vaccines started in distribution to first responders on Weds at FHS with over 200 delivered.

  • Real time reporting underway for the Finance Committee meeting. #fincom0113 main topic tonight is storm water. Jamie touts a doc released today (maybe to the committee) that will lay out the financial impacts
storm water utility fee
  • #fincom0113 DPW Director Cantoreggi reviewing the storm water presentation seen previously and adding updates where things have changed. Copy of presentation in agenda doc https://www.franklinma.gov/sites/g/files/vyhlif591/f/agendas/01-13-2021_fincom_agenda.pdf 
  • #fincom113 all of the storm water mitigation currently in the operating budget. Approx. $1.2m for storm water in budget for this.
  • With roadmap and progress you can show the effort to the EPA as mitigation for the permit issued to clean up the Charles River. Residential property less impervious property #fincom0113 reducing phosphorus is key. When asked if the town forest should be raked the EPA was quiet
  • #fincom0113 leaf pickup not in the first pass of the plan. Q Will we ever be done with the EPA? Maybe but these tend to be moving targets and something else could come along. So it doesn't seem like the fee would go away ever
  • Utility fee is much more equitable. Post office doesn't pay taxes, but will pay this utility fee. #fincom0113 yes, there will be a previous paver listing for approved credit against the fee
  • #fincom0113 Councilor Hamblen, had been chair for the ad-hoc Committee that worked on the utility fee. The fee for this will possibly be the lowest of the communities implementing a fee. Refers to the storm water page for additional info, pro/con, FAQs...
  • For reference, the storm water page can be found https://franklinma.gov/stormwater-division. #fincom0113 SQ footage of impervious surface on the property would equate to billable units - check out the map for your property to see if it makes sense. There may be errors, and they should be raised
  • Over a period of time, the ops budget for storm water would move to the storm water utility enterprise fund. Working to balance the sensitivity of the dollar impact. #fincom0113 discount would be equally applicable for storm water and other services for those eligible
  • It will take time for the fee to settle some market forces will play, cost of services applicable, #fincom0113 storm water director and four personnel, likely some may transfer from other depts to this, and when remains to be seen.
  • Initial presentation showed $2.3m and taking the leaf pickup out brought it to $1.2m #fincom0113 
COVID-19 update
  • Clinic at FHS did 200 vaccines for first responders today. Bellingham Milford Millis Medway and Franklin served collaboratively
  • Wait 28 days for 2nd shot for first responders, other smaller groups will be covered. Phase 2 is end of Feb/Mar. Can't answer yet as they don't have the info and guidelines to prepare yet. #fincom0113
  • It is time to pay attention as the vaccine and delivery is underway, the regs are changing daily, sometimes multiple within the day. #fincom0113 This is hard, we have never done this before. Voluntary now, no mandate now. Stay tuned.
  • Q schools have seen issues with staffing schools due to either contact or sickness, have we had any of that on the municipal side. Per Jamie, #s will change again as there is a 100 new cases here. #fincom0113 what the Federal govt will do after the 20th remains to be seen

Stormwater Utility Fee Recommendations

Document shared with the Finance Committee meeting on Jan 13, 2021 as a preview of the discussion coming up at a Town Council meeting soon.

 

Re:    Stormwater Utility Recommendations 
 
Dear Jamie,

Based on discussions, thoughts, and conversations of data presented over three meetings to the Town Council Stormwater Ad-hoc Committee a vote was taken on September 9th, 2020, of said committee, to present to the full Franklin Town Council the following findings and recommendations. These findings and recommendations are needed to implement a stormwater fee and program as previously established in the Town Charter and as required by federal law under the MS4 Permit.

Set the stormwater user fee at $18.66 per billing unit, per year: This would mean the fee for an “average single family household” (with 3 billing units) would be $56.00 per year, and billed at $14.00 per quarter. 
 
The fee would begin on January 1st, 2022.

The public may go to this website and review their personal property, how many billing units for their land and estimate the fee impact. Stormwater & Impervious Area Map.

Billing Units: The available billing units were updated and recalculated using natural rounding (after the first 1000 square feet (SF). Some additional points:

●    Properties with less than 200 SF are considered undeveloped and will not be billed a fee (as defined in the Stormwater Utility By-law, Section 153-21).

●    For properties with impervious area of 200 SF to 1,499 SF, they will be assigned one billing unit.

●    Since the Stormwater Utility By-law defines an individual billing unit equal to one thousand (1,000) square feet of impervious surface, each increase of 1,000 SF will increase the number of billing units by 1.

FM #426 - Franklin Matters Q&A Session - Dec 17, 2020 (audio)

FM #426 = This is the Franklin Matters radio show, number 426 in the series.

This session of the radio show shares the Franklin Matters Q&A session held by the Senior Center on Thursday, Dec 17, 2020. The session was conducted virtually via Zoom conference bridge to adhere to the ‘social distancing’ requirements of this pandemic period.

As I mention during the intro, there is no formal presentation for these sessions. I have at least a couple of things in mind that have changed since the prior meeting to review if folks are interested. We start with your questions, answer those, fill in appropriate background info and connections to other topics where applicable.

The Town Council and Rep Jeff Roy had held their coffee hour that morning. One of the questions to open with was around the Community Preservation Committee legislation that was just approved by the Council at their meeting the prior Wednesday night (12/16/20).

We also talk about the spear phishing incident, storm water utility fee, and the tax rate hearing before getting into the schedule for the next session, Jan 17 at 1:00 PM.

MMA: "EPA considers new regulations on stormwater pollution in Charles River watershed"

From the Mass Municipal Assoc (MMA) we share an article of interest for Franklin: 

"The U.S. Environmental Protection Agency notified stakeholders in the Charles River watershed on Aug. 13 that the agency is evaluating whether to introduce a new permit regulating stormwater runoff from private parties into the watershed.

A letter from the EPA’s New England Region stated that the agency is considering whether “a new program is needed to control stormwater pollution from certain commercial, industrial and institutional sources in the Charles River watershed at sites that are not currently covered by any existing federal or state stormwater permit.”

With a new permit, the EPA would be operating under its “residual designation authority,” a provision under the Clean Water Act that allows the agency, under certain conditions, to require permits for stormwater discharges that are not otherwise regulated."

  • Approx $1.2m in operations budget today could move to utility over time, recognize that the fee needs to build up some to be able to pay those invoices. Wouldn't start charging until 3Q 2021 due to billing change to system to add the line #swsc0909
  • Leaf pickup has not been included in this yet as EPA has not created the credit value for leaves. It would be a capital expense (to get the trucks/equipment) to do so. #swsc0909 moved to demo portion to highlight use of map
  • A great start to helping to provide the information to explain what it is #swsc0909 https://www.franklinma.gov/stormwater-division 
  • Would need to add how to calculate the billing unit from the impervious area. #swsc0909 would need to add the other approved surfaces i.e. to replace a blacktop driveway with some stone or other approved surface - what is the standard?
  • Motion to move forward to full town Council for review and discussion, second, passes 3-0 via roll call (Hamblen, Dellorco, Jones) #swsc0909
