Legislature Acts to Allow Virtual Notarization

Today House Speaker Robert A. DeLeo and Senate President Karen E. Spilka along with their colleagues in the House of Representatives and the Senate passed legislation to authorize notary publics to perform notary actions using video conferencing during the COVID-19 public health emergency.

“During the public health emergency it has been difficult for the public to process certain legal transactions especially those on behalf of those who are sick or dying, therefore the Legislature acted to ensure notaries can conduct business virtually in order to adhere to physical distancing measures,” said Speaker Robert DeLeo (D – Winthrop). “We must make sure that families, individuals, and businesses can execute wills, proxies, real estate transactions, and other important documents during the COVID-19 public health crisis. I am grateful to Chairs Michlewitz and Cronin for their work to act on this important issue.”

"Allowing for virtual notarization will mean important legal transactions can continue unimpeded, which is good for our economy and the Commonwealth as a whole," stated Senate President Karen E. Spilka (D-Ashland). "I am pleased to see this legislation advance as it will provide a safe alternative for residents and businesses during this public health crisis. I'd like to thank Senators Michael Rodrigues, John Keenan, Minority Leader Bruce Tarr as well as Speaker DeLeo and our House partners for their collaboration on this issue."

The legislation applies requirements for authorized notary publics to use electronic video conferencing for documents requiring notarization including those related to a mortgage or other conveyance of title to real estate, will, nomination of guardian or conservator, caregiver authorization affidavit, trust, durable power of attorney, or health care proxy.

The legislation includes the following provisions, which will be in place until three business days after termination of the March 10, 2020 declaration of a State of Emergency:

· Authorizes a notary public appointed under the laws of the Commonwealth to perform an acknowledgement, affirmation or other notarial act using video conferencing in real time;
· Makes valid notarial acts using video conferencing when the notary public and each principal are physically located within the Commonwealth as well as other provisions;
· Requires notaries to record the video conference and retain a copy of the conference; and related documentation for 10 years.

"By enacting electronic notarization legislation, we will ensure that crucial area of our economy will continue to function in a safe and responsible manner throughout the COVID-19 public health crisis," said Representative Aaron Michlewitz, Co-Chair of the Joint Committee on Ways & Means (D – Boston).

“This legislation will allow members of our communities to conduct necessary estate planning and real estate transactions safely without risking exposure to COVID-19 through the typical in-person notarization process,” said Representative Claire Cronin, House Chair of the Joint Committee on Judiciary (D – Easton). “Allowing for documents such as wills, durable powers of attorney, and deeds to be notarized utilizing video conferencing technology, while also including important safeguards to protect the integrity of the process, will enable these important transactions to continue to be carried out under existing public health restrictions. The steps taken by the House today will keep our communities safer during these unprecedented times."

“I am pleased Massachusetts has joined the over 30 states across the country that allow for remote notarization during this emergency,” said Senator John F. Keenan (D-Quincy). “We have given our families and friends facing difficult decisions, some peace of mind that they now have the ability to complete proper arrangements should they need to.”

“The COVID-19 pandemic has forced us all to adjust many of our normal routines and the way we conduct business for the sake of protecting public health and safety,” said House Minority Leader Bradley H. Jones, Jr. (R – North Reading). “This bill makes needed temporary changes to the notarization process to ensure that the execution of wills, the conveyance of property titles, and other important transactions can continue to take place while still observing proper safety protocols.”

“Documents like wills, trusts, healthcare proxies and those involving real estate are critically important, and we can't let them be out of reach because of the need for social distancing,” said Senate Minority Leader Bruce E. Tarr (R- Gloucester). “This bill allows technology to bridge the gap between protecting public health and keeping the integrity of the notarization process - meaning that legal documents can resume doing the job of estate planning, protecting assets, and facilitating transactions during this public health emergency.”

The bill, which is the latest action by the Legislature to address the COVID-19 public health crisis and its effects on Massachusetts, has advanced to the Governor desk.

FM #248 Franklin Public Library Staff Discuss Virtual Services - 4/14/20 (audio)

FM #248 = This is the Franklin Matters radio show, number 248 in the series.

This session of the radio show shares my conversation with the entire Franklin Public Library staff. We had our conversation via conference bridge to adhere to the ‘social distancing’ requirements of this pandemic period.

We talk about how the Library has become virtual continuing to provide services. I learned that in addition to the Library page, Facebook, and Instagram, they also have a TikTok and YouTube presence.

There are 75 databases that are online and available to us. Virtual storytelling, 2 minute book reviews, scavenger hunts, and the re-introduction of “doggie tales” scheduled for a virtual event are among the topics covered.

The Library is so much more than the 4 walls (really more than 4 anyway) as the services and resources they provide online we become aware of and can utilize during this period (and beyond).

Many of the online resources are available with your library card and pin. If you don’t have one, you can apply for a virtual one which will be good for 6 months.

The recording runs about 40 minutes, so let’s listen to my conversation with Felicia and all the librarians

Michael Lewin is one of America's most active and popular concert pianists, having played for audiences in more than 30 countries. His career was launched with victories in several international piano competitions. His numerous recordings have won a Grammy Award and a Round Glass Music Award. Mr. Lewin is Professor and Head of Piano at the Boston Conservatory at Berklee and Director of Classical Music for Ethos Music in China. He is a Julliard School graduate. His teachers included Leon Fleisher, Yvonne Lefebure, Adele Marcus and Irwin Freundlich.

FM #247 Doug McPherson HMEA Virtual IncredABLE 5K

FM #247 = This is the Franklin Matters radio show, number 247 in the series.

This session of the radio show shares my conversation with Doug McPherson, Vice-President of Development and Public Relations for Horace Mann Education Association (HMEA). We had our conversation via conference bridge to adhere to the ‘social distancing’ requirements of this pandemic period.

In our first conversation, Doug and I talked about the preparation for the HMEA’s IncredABLE 5K scheduled for May 17, 2020. Alas, in this pandemic period, the road race, community walk, and family fun field day has been converted to a virtual event. Virtual? Yes, we talk about how you can run your 5K on a certified 5K course and send your results in to HEMA to count.

Our conversation includes the other elements of the virtual event still to occur on May 17, but all virtual, not on the fields at Dell/EMC.

"50+ Job-seeker" sessions go virtual

Hi, most of you know me, but given how many people have been laid off recently, many of you probably do not.

To members of the Acton Networkers Group (ANG):

My name is Ed Lawrence; long-time ANG member; laid off 5 times during my hi-tech career. I've presented at ANG; worked for a State career center, and at the Boston University Center for Career Development. I'm currently a group leader (Hopkinton; Franklin) for the 50+ Job-seeker Program that was offered in 17 towns.

A short while ago, I shared the message from our director explaining how the 50+ program is going virtual. This is a great (and FREE) program with a proven track-record of success helping job-seekers.

I'm writing to promote the virtual program and suggest that you sign up.

I've attached a promo for you to share or print, but since Yahoo seems to drop attachments these days, I'm going to point out some info we need you to know:

1. Money drives everything. If you've been laid off recently, you totally understand. So, I need to point out how in order for the MCOA to keep this program going, it needs to show the State (and maybe Feds) that people are attending---SO WE NEED YOU TO REGISTER FOR THE PROGRAM.

2. Once you register, we add you to a list. For example, I keep a spreadsheet that I use for mailings to people who attend Hopkinton and Franklin sessions. Those mailings include the meeting dates and topics and invitations to join online sessions. You don't pre-register; you don't receive the info for the sessions.

3. Once you've registered for the program, you can register for any of the online sessions. Please understand, this two-step process is our attempt to prevent the general public and strangers from joining the meetings.

4. We have some participant guidelines for the online sessions; they boil down to simple courtesy.

I have the honor of facilitating the first virtual session --- Hopkinton virtual session is:  1pm - 4pm Monday April 6th (Franklin on 4/10 will be 9 am - Noon)
Three hours may seem like a long-time, but our in-person sessions were 3-hours (check-in and network for a half-hour; two-hour presentation; half-hour post-session-networking). And I think we will keep you entertained. (And will we even need three hours? You'll let us know!)

I have two special guests lined up for Monday:
1. Diane Darling, a nationally known networking and social networking expert.
2. Kara Cohen, of the AARP, who will talk about how AARP can help you.

In addition, we plan to take advantage of Zoom features, such as breakout rooms, to enable networking in small virtual groups.

Please note---Every participating town Group Leader will offer virtual sessions. So, if you have a favorite group leader or friends you used to meet at the in-person sessions, you can sign up to see them (virtually) again.

I hope this note explained what you need to know, without boring you.

FM #229 - Town Council Remote Mtg 3/25/20 (audio)

This session of the radio show shares the first Town Council meeting held remotely via a conference bridge. It may not be the last as we all adhere to the new ‘social distance’ requirements of the COVID-19 pandemic.

The meeting was held for two reasons; one a practical agenda item, to revise the current Town Council meeting schedule; and two, to practice this new format so when the next meeting comes in April, folks would be better prepared.

The Coronavirus (COVID-19) continues to test us, but our Commonwealth and communities have stepped up to the challenge. Our goals are to keep infections down and to watch out for one another. Communication is key at this time and that's why I send along these updates regularly in addition to updating my website. New information is coming out regularly and in great volume. To keep the information timely and manageable, I will continue to post only new information in these update emails. Here are the updates since my last email:

Office hours. I will be hosting office hours on Friday morning (March 27) at 8:30 AM via Zoom. Franklin Town Administrator Jamie Hellen and Town Council Chair Tom Mercer will join me this week. We will discuss state and local issues and answer your questions until 9:30 a.m. I will try to arrange a similar meeting with Medway town officials as well in the next few days. On St. Patrick’s Day morning, U.S. Rep. Joseph Kennedy III took to Twitter in a baseball cap and plain white T-shirt with his two young, pajama-clad children.

“Take care of each other, take care of yourselves, take care of your families,” he told his more than 82,000 followers, before his daughter Ellie broke into a confident rendition of “Do You Want to Build a Snowman” from Disney’s “Frozen.”

As social distancing becomes the norm, several local, state and federal elected officials are turning to remote services like telephone and video to connect with their constituents.

“We’re deploying the full menu of technology,” said U.S. Rep. Lori Trahan on Friday. “Our office is very much open for business.”

Coronavirus response adjustments in new municipal bill
"Restaurants would be able to sell beer and wine with to-go orders, requirements around MCAS tests could be changed and municipal governments could give residents more time to make tax payments, under new bill Gov. Charlie Baker filed Tuesday to create flexibility in local responses to the coronavirus pandemic.

Baker and Lt. Gov. Karyn Polito introduced the bill during their daily coronavirus update, with the governor saying it “cuts red tape for cities and towns” and aims to make it easier for municipalities to meet their residents’ needs and keep their governments running.

“It’s clear that we have to stick together, but stick together in a time where social distancing is becoming and is very much a real part of our lives,” Polito said, voicing appreciation for local governments offering services via remote workforces, boards of health ramping up their efforts, and first responders who continue to deal with emergencies like house fires.

Filed the same day that an emergency order closed most of the state’s businesses -- except for essential operations like grocery stores and medical facilities -- and with the Department of Public Health advising residents to stay home, the bill (HD 4974) contains a number of provisions."

"Some gyms across the nation are closing, but that doesn’t mean you can’t workout. Planet Fitness, one of the nation’s largest chain gyms, is offering free online classes starting today, because of the coronavirus pandemic.

The at-home workouts began streaming on the company’s Facebook page March 16. These classes are open to anyone, including non-members.

“Our daily routines have changed in unexpected ways, and we know that people may not be able to get to the gym. That’s why we’re offering a free, daily virtual fitness class for everyone on Planet Fitness’ Facebook page from Monday through Friday,” said Jeremy Tucker, chief marketing officer of Planet Fitness, in a statement to USA TODAY.

The workouts will be live-streamed at 7 p.m. ET each day for the next two weeks. And if you can’t make it live, the workouts will be available on-demand on Facebook and in Planet Fitness’ YouTube channel. No equipment is needed, and the classes last 20 minutes or less."
