State Education Mandates - Part 6

From time to time, particular around the budget period, reference is generally made to Franklin Public Schools having to support "unfunded mandates." I managed to find a listing of such compiled by the Massachusetts Association of School Committees. This is Part 6 in the series:

Curriculum

Frameworks. Districts revise and create new curricula to conform to the state curriculum frameworks and demands for timely update as the revises and updates frameworks on a regular basis. This work must be done after school and during the summer. Instruction hours must provide at minimum 990/900 hours of instructional time.

Individual Student Success Plans. Districts are required to deploy administrative, teaching, secretarial, guidance, and technology staff and resources (including but not limited to intervention programs in ELA and Math) to ensure that students receive additional support services that address individual student needs as a result of statewide assessment mandates (MCAS). Instructional support and resources such as texts, workbooks, and online instruction are examples of areas that require increases in expenditures.

Curriculum Requirements. The Massachusetts Curriculum Frameworks require that districts provide additional instructional staff (e.g. health teachers and guidance staff) to ensure that all curriculum areas are addressed. The periodic review and alignment of every curriculum area requires substantial investment in time (including committee review, curriculum development, printing and dissemination of curricula) and resources (texts, consumable items, and online access).

The length of the school year (180 days) requirement impacts costs incurred for snow and ice removal and climate control in multiple buildings.

Note: on the length of the school year, it is defined in days (180 required) but as we recently found out with the Horace Mann/Oak Street complex problem, the State has not yet defined how much time qualifies as a "day" of school.

10th Norfolk candidates state positions

I was unable to get a good internet connection to report live from Medway High School but took my notes by hand and have transcribed them to share here.


10th Norfolk District candidate debate

Republican candidate - Richard Eustis
Democratic candidate - Jeff Roy


Co-hosted by the Republican and Democratic Town Committees of Medway at the Medway High School

The format was for both candidates to have an opening and closing statement and in between state their positions on a set of five topics; (1) Education, (2) Economic Development, (3) Local funding, (4) Tax policy and (5) the Role of government.

There are distinct differences between the two candidates as shown in their statements on each topic.

Opening Statements
Roy - provided an overview on his public service record and how he will represent everyone in the District.

Eustis - opened with a challenge to Mr Roy’s statement that MA is doing it right and went on to list the litany of corruption associated with Beacon Hill and the Democratic Party. Referenced the Forbes study that listed MA as 47th among the states as a place to do business.

1 - Education
Eustis - cares about schools, understands the need for investment in the community, recognizes that stronger schools will make the community more attractive for businesses. Doesn’t support instate tuition for illegal immigrants because the state can’t afford it. Thinks the college tuition is too high and that with 50% of the recent graduates still looking for work says that is a problem that needs to be addressed.

Roy - every child deserves a good education, invited Mr Eustis to tour the Franklin schools with him to see how well they are doing spending less in all 11 categories tracked by the state and yet a high performing district. The good schools are why businesses come here. Tri-county and Norfolk provide area students alternatives. He does not favor the Governor’s proposal on instate tuition. Thinks that we should focus on the local issues.

2 - Economic Development
Roy - wants to help businesses get back to work, with good schools businesses want to locate here. he goes on to reference three companies in Franklin two of whom relocated there and the reasons were good work force, good school system and quality of life in the community. Referenced a study by Associated Industries of Massachusetts (AIM) http://www.aimnet.org/ that touts the progress MA has made during this recent economy has been the envy of other states and regions. Can we do better? Yes. His strategic plan on economic development covers five points: 1 - money to consumers by reducing the sales tax to 5%, 2 - helping small businesses, 3 - help public higher education, 4 - reduce the cost of doing business here, and 5 - partner with the leaders in Franklin and Medway.

Eustis - I will continue to bash Beacon Hill because their performance is unacceptable. According to the Forbes report MA is 47th among the states as a place to do business. That tax rates and regulations have scared away ⅓ of the businesses who were based here in MA. RI and NH in particular have lured companies with tax breaks and incentives. MA is not competitive. As an example,the data security protection regulation implemented goes further than the FDC requires, why is that necessary? Need to follow the examples set by our neighboring states, need to enforce immigration laws.

3 - Local Funding
Eustis - wants every dollar that goes to Beacon Hill to come back, local government should make the choice, makes local government accountable, the the towns are running on increasingly tight budgets yet there is waste, fraud and abuse with the money that leaves here. Referenced EBT card abuses, the creation of 2,000 jobs in state government where the salaries exceed $100,000, the scandal in the probation department. He closed by reiterating that he would fight for every dollar to come back.

Roy - I am a fan of Massachusetts. In a rebuttal of the Forbes study referenced, many of the same CEO’s in the survey actually live in the places that are lower ranked, CA, NY and MA. Why is that? They’ll live in the lower ranked state but not do business there? Agrees, that local aid is important. Education, parks and green spaces, senior centers, all of these things are paid for with public funds, we are not funding Republican or Democratic facilities. Stated he is opposed to illegal activities, violators need to be prosecuted to the fullest extent of the law. Attempted to link the Beacon Hill challenges to an attack on former Rep Vallee and asked Mr Eustis why if he was so interested in the party abuses didn’t he do something about it? Closed with he has the experience to get local aid for Medway and to spend it appropriately in the priority areas.

4 - Tax Policy
Roy - opens with ‘nobody likes to pay taxes’, taxes fund our government operations and our budgets should reflect our values. He reiterated his desire to roll back the sales tax to 5%. Wants to collect taxes on internet based sales. MA is losing $335 million in this arena. Not collecting this tax, creates a competitive disadvantage for those brick and mortar stores. He wants to ensure no unfunded mandates come from new legislation. He wants to look at tax haven abuses. MA is doing well as it has gone three years with no new taxes or fees. He would like to see an analysis on tax credits to see that they actually return what they are supposed to.

Eustis - Opens by objecting to Mr ROy’s linking of Vallee to Beacon Hill. you know I like Rep Vallee, “don’t do that Jeff.” He then questions state government, if the CEO’s don’t rate MA higher, how are we better off? We are taxed at the highest rate in the nation. We don’t have a revenue problem, we have a spending problem. Stated Mr Roy opposes the tax free weekend and can’t understand why. All you need to do is drive down an exit or two to the Wrentham Outlets to see how much of an effect it has. Reiterates the need for MA to be competitive in the region, wants to explore a tax exemption for seniors, of the 21 communities who have declared their tax rates, all 21 have increased them. People need tax relief not an increase in taxes.

5 - Role of Government
Eustis - He stated that there are two roles for government, the first is to provide the common services (public safety, education, and the safety net for those in need). If there was a second point I missed it. He did reference MA as having create the first constitution and how the US Constitution defines government. That ‘what we think (as candidates) doesn’t really matter’. His shortest statement as he surprised Mr Roy by ending without using all of his allotted time.

Roy - government is the name we give to that which we do together. Government doesn’t do everything, it does provide an opportunity. He told a story of meeting a mother of an FHS student who as a sophomore was struggling with school until he took advantage of the new Arts Academy program at FHS. Now as a junior he is excited about school and looking at where to go to college. We need to create these educational opportunities. Help those in their later years. Need to do the common things, build roads and bridges, greenspace, without being dependent for everything at Beacon Hill.

Closing Statements
Roy - gives series of thanks to those who organized this, those present, has respect for Mr Eustis, is overwhelmed by the support and endorsements he has received. Refers folks to read the letters available on his website. “Can we do better? Of course we can” We are modeling how to do it better. I will help spread the word. I will combine my experience and energy to make MA a good place to work and live. The question this election is who has the most commitment? who has the most relevant experience? who is the best qualified to represent Franklin and Medway? I have all three of these and I look for your vote on Nov 6th.

Eustis - gives series of thanks to those who organized this, those present. Reiterates that this election is about a choice. If you think MA is going in the right direction, then he is not your candidate. He didn’t talk about his local service but did serve in the Navy for four years. He did serve in other ways, his work as an attorney, never turned someone away for inability to pay, always provided service at a reduced rate and gets great satisfaction from doing so. In reference to Mr Roy’s endorsements, his mother had said; “Show me your friends and I will show you who you are.” Closed with a story of helping a lady shopping with her daughter at Market Basket, lady was challenged by shopping and trying to make ends meet with little money.We need to do better, we deserve more from our state government.

The next debate will be held on Tuesday, Oct 23 at the Horace Mann Middle School on Oak St in Franklin, MA. It will begin at 7:00 PM.

Administrator's Message - Sep 17, 2008

A Message from the Administrator


Before you know it, fall will turn into budget season. Next year’s budget continues to hold many challenges. The Town Council has appointed a special adhoc committee to look at the next 3-5 years and try and predict the town’s fiscal plight. The committee plans to hold public hearings and ask for citizens’ input into the age-old question of services versus taxes. While we have been blessed with very generous amounts of state aid over the last 15 years, (thank you Representative Vallee) we cannot rely on the State for the same commitment in the future. Our choices are: ask the legislature to allow for local option taxes, change the tax laws to escape the over reliance on the property tax, or ask the citizens to increase their commitment above the Proposition 2 ½ limits allowed by law. I can already hear folk’s saying, “What about living within your means?” “Why can’t the town live within the revenue available?” “Why do you always ask us for more money?” Well, we can live within our means if you want a lot less “local government”. I have pointed out many times that we don’t control the cost of energy, health insurance premiums, or pensions. Collective bargaining, public bid, prevailing wage laws, and unfunded mandates all drive up the cost and size of government and make it difficult to control costs. There is little support for regionalization of services or consolidation of governments. Federal and State education mandates drive up the cost of education. Also, we can’t ignore our aging infrastructure. We have to update the nearly 40-year-old high school and some of the other schools, the Library needs repairs, and our roads and sidewalks constantly need repairing and updating.


There are no easy answers. We hope for citizens’ input. As we struggle to define the balance between taxes and services, we reach out to the citizens to give us their opinions and help us to decide what is best for all. This is your government. We need your participation at public meetings and hearings and on every Election Day. Your quality of life, protection of property values, and commitment to the next generation is in your hands. Please don’t sit on the sidelines. Watching on TV, reading newspapers, commenting on blogs & websites is fine, but your local government is a “contact sport” and we need to see you and hear you. We ask for your participation in defining what kind of community that you wish to belong to. Please call, write, visit or email me with questions and comments.

Teacher salary freezes are not the solution to Franklin's financial issues


Disclosure: Mrs Sherlock teaches kindergarten at the Oak Street School. Our two daughters are the product of Franklin's school system, both graduated from FHS and (#1) is out in the working world and (#2) is working to complete her college studies.

The financial issues here in Franklin have been brewing for many years. Jeff Nutting, our fantastic Town Administrator, has worked very well to operate within the constraints provided by the Franklin voters. The Franklin portion of the overall Town budget has declined from about 70% to 50% as we benefited from political connections and the generosity of the Commonwealth of Massachusetts.

The real issue that will require action is the unfunded Federal and State mandates that drive the costs up. The impact is seen mostly on the school side but there are almost equal restrictions on the Town side.

The time has come to understand the mandates that have been imposed upon us and to take on the Don Quixote approach to go tilting the State House and other government bodies to get these mandates changed.

State Education Mandates - Part 8

From time to time, particular around the budget period, reference is generally made to Franklin Public Schools having to support "unfunded mandates." I managed to find a listing of such compiled by the Massachusetts Association of School Committees. This is Part 8 of the series.


School Choice

This program requires all school districts to admit students from other districts in the state unless the host school district takes action to restrict or prohibit accepting non-resident students from other Massachusetts school districts.

• Admitted choice students’ siblings are thereafter entitled to enrollment in the school also, even when there is little or no space for new local students to enroll. Districts losing students to choice have no control over the students who choose to leave and are charged for the cost of those students as assessments on the Cherry sheet.
• With declining enrollments and constraints on local funds, it is expected that this “free-market-choice” of school districts will expand causing a drain on resources from more vulnerable school districts. This will have an affect on the capacity to address issues for low-income school districts often having the neediest students.

Charter Schools

School districts have no control over students who wish to attend charter schools rather than the local district and local residents have no say in how these schools operate or how their tax dollars are used unless they happen to be selected by the charter school to serve on its board of trustees. In other words, charter schools operate outside the reach of city, town, and regional government.

• Many persuasive arguments have been made to demonstrate such counter-intuitive outcomes as lower numbers of special education students enrolled, the virtual absence of limited English proficient students, and the ability of charters to transfer students out of their school back to the public school district.
• We believe that the current charter school funding formula is unreasonable because it draws away from a city or town (or region) chapter 70 allocation

State Education Mandates - Part 5

From time to time, particular around the budget period, reference is generally made to Franklin Public Schools having to support "unfunded mandates." I managed to find a listing of such compiled by the Massachusetts Association of School Committees. This is Part 5 in the series:

Home Schooling

The district must monitor and document all home-schooled students. This includes identifying families and reviewing detailed home schooling plans for compliance with state guidelines. Though school districts are required to provide this oversight there are not funding or reporting requirements to or from the state.


MCAS Testing

MCAS testing is required annually in grades 3 through 10. Students must pass the grade 10 testing in math and English in order to graduate from high school. All students must be proficient in English/Math by 2014, requiring needed extra help and extra time on task to meet this goal. District must continually upgrade the curriculum to keep up with the testing.

• Districts must provide special tutoring for students who do not do well in the testing and must track and contact non-graduates if they fail MCAS. This requires guidance time and mailings.
• The costs for instructional time and funds associated with the preparation for, documentation for, administration of, and reporting about the multiple assessments in grades 3-10 are difficult to quantify.

MA Senate Passes Legislation Expanding Protections for Reproductive and Gender-Affirming Care

The Massachusetts State Senate on Wednesday 07/13/22) unanimously passed a bipartisan bill protecting providers, residents, and visitors to the Commonwealth who engage in legally-protected reproductive and gender-affirming health care.

An Act expanding protections for reproductive and gender-affirming care includes provisions preventing the Commonwealth's cooperation with 'bounty-style' anti-abortion and anti-gender-affirming care laws in other states, mandates health insurance coverage for abortion and abortion-related care with no cost-sharing, ensures access to emergency contraception, and provides confidentiality to providers of reproductive and gender-affirming care. Senate Bill 2996, filed by Senator Cindy F. Friedman, expands on her amendment to the Senate Fiscal Year 2023 budget, which was filed in response to the leaked U.S. Supreme Court opinion on Dobbs v. Jackson and adopted by the Senate in late May.

"We cannot let other states threaten Massachusetts pregnant and transgender people, or the providers who take care of them," said Senate President Karen E. Spilka (D-Ashland). "Massachusetts will not waiver in protecting our residents' rights. The legislature prepared for the end of Roe v. Wade by passing the ROE Act in 2020, which ensured the continuation of reproductive healthcare services when we could no longer count on the federal government. Now, we must prepare our Commonwealth for the potential further erosion of our rights and protections at the federal level. I want to thank my colleagues in the Senate for their swift and decisive action."

"The Senate has taken important steps to confront the threats posed reproductive and gender-affirming health care in our state posed by new, draconian laws being passed across the nation," said Senator Michael J. Rodrigues (D-Westport), Chair of the Senate Committee on Ways and Means. "Though these changes are unprecedented, we in Massachusetts are continuing to demonstrate that we are prepared to defend the rights of all of our residents. Thank you for the hard work and collaboration of Senators Friedman, Lewis, and Jehlen, and the leadership of the Senate President."

"Passing this legislation is a monumental step forward in Massachusetts, as we are seeing increasingly more anti-abortion and anti-gender-affirming care legislation rise across the country," said Senator Cindy F. Friedman (D-Arlington), Senate Chair of the Joint Committee on Health Care Financing and the lead sponsor of the bill. "We must do everything to protect the rights of our providers, patients, and visitors to the Commonwealth. As we further realize the impact of the U.S. Supreme Court's decision in Dobbs v. Jackson in our Commonwealth, we will continue to fight these attacks on reproductive and gender-affirming care with meaningful action."

Under the legislation, physicians, nurses, physician assistants, pharmacists, psychologists, genetic counselors and social workers are insulated from legal action in Massachusetts courts as a result of providing health care services which are legal in Massachusetts. This language specifically protects reproductive and gender-affirming health care, which has been the target of 'bounty-style' laws passed in states like Texas and Oklahoma that seek to limit this critical care beyond their states' borders. This bill also allows anyone who faces abusive litigation in another state for providing legally protected reproductive and gender-affirming care services to sue in Massachusetts court to obtain a judgment, including actual damages, expenses, costs, and reasonable attorney's fees.

The Governor would be prevented under the legislation from extraditing someone to another state to face charges for an abortion, gender dysphoria treatment, or another protected service, except when required by federal law or unless the acts forming the basis of the investigation would also constitute an offense if occurring entirely in Massachusetts. Massachusetts law enforcement agencies would also be prohibited from assisting any investigation by federal authorities, another state, or private citizens related to legally protected reproductive and gender-affirming health care provided in the Commonwealth. Courts would similarly be barred from ordering anyone in Massachusetts to testify or produce documents for lawsuits involving those practices, and judges could not issue any summons in a case concerning those health care services unless the offense in question would also violate Massachusetts law.

An amendment was adopted during debate which requires public higher education institutions to work with the Department of Public Health (DPH) to create a medication abortion readiness plan which must provide medication abortion at a health center on campus or provide a referral to a nearby healthcare facility offering abortion health care. It also creates a trust fund for public higher education institutions to support the implementation of their medication abortion readiness plans.

"I was proud to join my Senate colleagues today in passing this critical legislation to further protect and expand access to reproductive healthcare in Massachusetts," said Senator Jason M. Lewis (D-Winchester), lead sponsor of the amendment to work with public higher education institutions to support medication abortion plans. "I am especially pleased that the bill includes expanding access to medication abortion services on our public college and university campuses to help students overcome the significant barriers to care that many face today."

In response to stories about women not receiving access to abortion care in Massachusetts currently allowed under the existing state law, an amendment was adopted to clarify the circumstances that treating physicians must consider when determining whether to provide later-in-pregnancy abortion care. The amendment requires such determinations to be made by the treating physician and patient. To ensure hospitals are complying with the law, the amendment also requires health care facilities providing these services to file their procedures and processes for providing services consistent with the law with DPH.

"Later in pregnancy abortions are extremely rare, but often occur because of devastating, heartbreaking circumstances, such as the inability of the fetus to survive outside of the womb," said Senator Patricia D. Jehlen (D-Somerville), lead sponsor of the amendment to clarify law on later-in-pregnancy abortion care. "So that no pregnant person is denied the reproductive care they may desperately need here in the Commonwealth, I was proud to sponsor this amendment, which strengthens and clarifies the language of the ROE Act, and makes sure that hospitals providing later in pregnancy abortions ensure that the physician and patient are able to make the determination about the best course of care."

Additional amendments would identify areas of the state with limited abortion access to increase care to those areas and allow pharmacists to prescribe and dispense hormonal contraceptive patches and self-administered oral hormonal contraceptives.

Senate Bill 2996 implements a statewide standing order to ensure that emergency contraception can be dispensed at any pharmacy in the Commonwealth. In addition, the legislation requires the Group Insurance Commission (GIC) and commercial health insurance carriers to cover abortions and abortion-related care and ensure Massachusetts patients are not charged a cost-sharing amount, such as deductibles, copayments, or similar charges, for such coverage. It also requires MassHealth to cover abortion and abortion-related care and ensures enrollees are not charged a cost-sharing amount for prenatal care, childbirth, postpartum care, abortion or abortion-related care.

The bill also allows individuals engaged in the provision, facilitation, or promotion of reproductive and gender-affirming health care to enroll in the Secretary of the Commonwealth's Address Confidentiality Program (ACP). This action will increase the safety of those who may face threats or violence outside of the workplace in their personal lives or at their residences.

With a version of An Act expanding protections for reproductive and gender-affirming care having passed both branches of the legislature, a conference committee will be appointed to resolve differences between the bill's two versions.

10th Norfolk: Collected questions for Democratic debate

My questions:

What have you done or are planning to do to prepare for serving Franklin in the Legislature?

Two part Q: What do you see as Franklin’s key issue at the State level and how do you plan to address it?

Do you have any relationships with folks in or around the State House or in the Legislature that you can leverage when you are in office to help serve Franklin? Please elaborate.

Based upon the flyer on the door, it seems like you are both walking the neighborhoods. What is one thing that going door to door does for your campaign?

How much will websites and other social media tools help your campaign?

Franklin Candidate Interview: Tom Mercer


This interview with Tom Mercer, candidate for Franklin Town Council in 2019, was collaborated on via email. We reviewed the following questions, some of them were ‘crowd sourced.’ Some of you may remember the call for input solicited in August 2019 for this election. Thank you for your contributions.

Hopefully, the information provided here, and in the other interviews, will enable the Franklin voters to make a good choice among the candidates for each position.

For the following FM presents the question. TM represents Tom’s response.
FM = There are and have been many opportunities to volunteer with community groups in Franklin. Have you taken advantage of any of these? Which ones, and why did you choose that/those?
TM = I am a lifelong resident of Franklin and I have successfully served you, the residents of Franklin, as a Town Councilor for the last 8 years, and the last year as Chairman. Previously, as a School Committee Member for 10 years - 8 of which I served as Chairman. I was Chairman of the Building Committees for 3 of our largest and newest town structures – the Horace Mann/Oak Street/ECDC School Complex, the Franklin Senior Center, and most recently the new state of the art Franklin High School. I served as a member of the Dean Community Council. I have served on the Franklin Country Club Board of Directors for over 20 Years. I have also served on the Franklin Performing Arts Company Board of Directors for over 30 years.

FM = Where do you get your news about Franklin?
TM = Franklin Matters and the Country Gazette along with the news feeds from the internet.

FM = For all those running for Town Council: We are in a constant water shortage. We are adding to our population and increasing out need for water. Given that all those who live in Franklin draw their water from the same aquifer, do you support a ban on using water for what I will call cosmetic use (lawn watering) during water shortages, even for those with a private well? If not, why not, considering that those with private wells are still dangerously affecting our water level for uses other than vanity? Or put simply: Do you support the private use of wells for lawn irrigation at times when the town's aquifer is dangerously low for use by the community for essential use in homes and fire prevention?
TM = This is not the exact way to phrase the problem or solution. the private well issue question usually comes black and white, and the debate can be divisive and counterproductive. Also, private well owners are not the single source of a town water problem or shortage.

The fact is we have very good water quality in Franklin and a safe quantity of it. The best way to address water protection is education and best practices at the individual property owner level and good infrastructure investments. 

The town is investing almost $11 million in the reconstruction of wells 3 and 6 off Grove Street to allow us more capacity and better quality. One of the wells right now is shut down due to high iron and manganese levels. But we’ll have a new facility which will help the system. We also just began a new 5-year water main pipe replacement schedule. Consistent infrastructure investments are actually a more effective way to conserve and maintain good water systems.

I’m not clear where this “acquifer is low” claim comes from. Not saying it’s not true, but it really doesn’t matter because the Town is in very good standing with the state DEP with our Water Management Act permit, which regulates town wide water use. It’s actually our Permit with the state that mandates we have mandatory water conservation days, but this is not uncommon. The state of Massachusetts and cities and towns are relatively good at water protection.

The Town DPW and Water Department have won state awards for water conservation. Our system is in good shape right now. Future challenges will be continued innovations and maintenance of the system, as well as stormwater.

FM = What degree of development do you feel is appropriate for Franklin, and how would you balance the need for affordable housing, with the need to avoid congestion?
TM = Two years ago the town reached its 10% goal of 10% affordable housing stock by state laws. It allows us to have full control over our own zoning without a 40B housing project being approved by the state and overriding our local zoning. There are few higher priorities than to maintain that 10% status. And that will always be the housing goal, as Chapter 40B has been in state law for fifty years.

the Town Council will have many future debates on zoning, and how the town may want to address this recent growth spurt. It’s a difficult balance, and we will need citizens to participate in these coming years on the issue of development and growth. What do people in this community want to see in the future?

The Town is just over halfway through its ten-year Master Plan process. The Town Council will have an update on that sometime in 2020, as the Town prepares to start that process again in the not too distant future.

The Town Council should approve large cash reserves this year for open space protection, $900,000 in October 2019 which will bring the fund to $2.1 million.

FM = The Town Administrator has suggested that Franklin needs to pass an override measure. What actions will you take to support the passage of this measure?
TM = First, we’ll need to monitor the towns’ budget situation closely throughout the year as the Town Administrator and Superintendent build their budgets. I’d expect that we would have a reasonable number in late January. My guess is the next Town Council and School Committee will have to discuss an override, how much and for what and what the community strategy may be.

At this point, I support and hope a discussion will occur next year on discussing with taxpayers a revenue increase. As the Town Administrator has stated numerous times, the cost of doing business is far exceeding our ability to raise revenue. Construction costs, personnel costs and Heath care costs are increasing at a rate that has put stress on the system relative to service demand. It’s a partial symptom of a good economy for sure. And it’s something we need to really engage a wider audience in the community on. Everyone will need to be involved. As ultimately any override is a decision made by the Community as a whole not the Town Council. It is the Town Council’s job to provide the community with all the facts so they can make an informed decision.

FM = Why should I vote for you?
TM = I believe that I have the knowledge to ensure fair and honest representation for the residents and businesses of Franklin. I will work to keep and improve services and spend our tax dollars wisely. Having been previously elected and having served in local government, I am aware of the personal demands and political pressures - but I continue to look forward to those challenges.

I will continue to work hard to improve the communication between town boards both elected and appointed. Franklin deserves leadership dedicated to open government, safe schools, and a healthy local economy. I have built a solid reputation as a leader, facilitating cooperative, and constructive discussions that have led to success. I am proud of my track record, and I ask for your vote on November 5th.

Rep Vallee - the strides made in this community have been tremendous, these have brought so many new folks to the community as well. It is distressing to dismantle something that is doing so well, a portion of your budget is based upon State aid - you are so reliant State aid. School construction is now budgeted with a definite revenue stream after having gone wild several years ago. A challenge for us to continue to contribute to a quality education. The formula is so complicated, only one or two people perhaps know all the ins/outs.

Roy - I am so excited that you had a chance to see that presentation. We are down about 100 teachers but the spirit of the program remains in the system. No matter what adversities arise, they step up to them. I don't know if you can shed some light on what is coming down, we were delighted to see that the Governor's number didn't cut so much.

Sen Spilka - where as the school budget saw an increase in aid, other services (Dept of Mental Health, etc.) are stepping forward to ask for their cause. There may be some shifting around. Local aid and Chap 70 has been a priority for me. This budget will be the toughest budget yet, things will get better after this. We are on the rebound getting out of the recession. We are moving out of the recession faster than other states, rated 5th best state to do business in the nation. For those not employed or under-employed, this means nothing. Creating jobs is our number one priority. What ever we can do, the more jobs we can create, the healthier the revenue will be.

Roy - We are thankful that the two of you have returned to Beacon Hill. We appreciate the fact that you are helping us.

Rep Vallee - certainty is something to have, not something elusive, in our community we have been doing this for a while. State aid can't continue to rise every year, having some certainty we can at least make some plans. I get the calls too! It is hard. It is something I would like to see achieved.

Cafasso - We talk about local aid, it is 54% of our budget, we should be thankful, and we are. Both of you have done well by this district. It is time for the citizens to bear more of the burden for this district. We are very appreciative of your continued support.

Sen Spilka - I have been filing legislation in an attempt to find an alternative source to the property taxes.

Rohrbach - It is a scary position, when state aid goes down, it is a problem for us. How long will it take to adjust the huge cruise ship to a different model/ The circuit breaker is one item if we could close to the Gov's number. We pay about a million dollars for out of district transportation.

Sen Spilka- I did file legislation to help communities like this. All of them geared to reducing the cost of special education.

Glynn - thank you for your efforts. I attended a suburban coalition meeting last week. It is very disheartening to know, what we have been doing via cuts with what we have had and comparison to other towns where they get less state aid.  For something that is a national priority, you can’t expect to finance it via homeowners, that’s a broken financial model. We are talking about hundreds of kids here in Franklin, this effects thousands of kids nationwide.

Rep Vallee - the model that we have, we were sued and lost. So the State passed Ed Reform to address that. The model is not sustainable. We patched the tire instead of fixing the model. There are a lot of people who agree with us. No one has come up with an acceptable solution. When you start contracting budgets, it forces you to look at things. To think outside the box to come up with a solution. We know the formula, we stabilize a country and educate the kids overseas. We need to change it here.

Sen Spilka - I was on the School Committee previously, my first intro to Beacon Hill was lobbying it. We need to get to critical mass. We did make a change five years ago. It was supposed to be on a five year plan. I am not sure aggregate income is the way to go. We did get some predictability from the Dept of Rev. We did make it simpler. It sill is not fully simple. The piece that eluded us is adequacy. The constitution mandates it but the definition of adequacy has changed. There are so many factors. The Dept of Ed is undertaking an adequacy study now. Hopefully by this summer, we'll have some results. What should be built into the funding formula. That I am hoping will be a springboard for the next round of ed reform.

Voices of Franklin: Vanessa Bilello

Dear Town of Franklin voters-

Community members may not realize the incredible time commitment that all who hold local, elected positions on School Committee or Town Council make to our town. Workshops, subcommittees, and other responsibilities extend far beyond an every other week meeting in Council Chambers. 

Being an active, engaged member requires not only passion for the issues, but also a willingness to balance professional and personal needs with intense demands of public service volunteer work. Several months ago, with elections quickly approaching, I announced my decision to not seek re-election for the Franklin School Committee. The demands were too much given my hectic life as a new public school principal and mom to two middle schoolers. 

In the Town of Franklin, all seven seats on School Committee (and Town Council) roll over every election. For this reason, I urge voters of Franklin to re-elect Mrs. Denise Schultz and Dr. Anne Bergen to the Franklin School Committee, so that they can continue the efforts that they began two years ago and serve as leaders for the newly-formed Committee.

I'm incredibly proud of the hard work and accomplishments during the last two years through the collaboration of our Franklin School Committee and the educators in our schools. Strong District and School Improvement Plans, successful labor negotiations and most critically, the hiring of our new Superintendent, Dr. Sara Ahern are highlights. 

I’m also especially proud of the addition of our active Community Relations subcommittee, which has been instrumental in facilitating dialogue between the community and school leaders on a variety of issues. A huge “thank you” must go out to Denise Schultz and Anne Bergen- for initiating and setting up avenues to engage with the citizens of Franklin through regular coffees and conversations around our town. 

Two-way dialogue is going to be key moving forward in the challenging budget times that Franklin is facing. Anne and Denise- through their dedication, outreach and partnership with other groups, such as the Joint PCCs and MASC, are models for integrated collaboration.

As a School Committee, we’ve established a new liaison role- to promote dialogue with state leadership, which will be critical moving ahead with the challenges of public school funding in our state. Denise Schultz has been instrumental in opening these avenues up and I do believe that while local involvement and budgeting are essential, partnering with area towns and state officials are paramount as we face the growing budgetary challenges of Massachusetts public schools. 

Additionally- improvements to several key policies. Denise has also played a huge role in ensuring that our Policy Sub-Committee tackled such issues as dress code, handbooks, school vacations, and homework. Her dedication and passion for these issues (as well as school start times, social-emotional welfare of our students, and nutrition in schools) make her an ideal choice to continue on the Committee.

I’d like to say thank you to the Franklin educators- teachers, administrators and staff of our district. Having been a colleague of theirs for years as a special educator, I know how incredibly hard they work to give our children the high quality education they benefit from. Despite being in the bottom 30 or so school districts across MA for funding, the education they provide our children is top notch. However, they are asked to do too much with too little. 

Increasing mandates upon our schools along with other budgetary demands, especially combined with the approximately $4.1 million we lose yearly to our area charter have resulted in cut after painful cut - foreign language, music, librarians, kindergarten support aides, so many more. These were not nice to haves- they were needs- and we’ve lost them. 

Mandates are not all bad as people think- they include new technology standards, more rigorous science standards, required mental health screenings, wellness curriculum and improvements to educator evaluation and supervision. I could go on and on. Many of these mandates require more time- and more money. Teaching digital learning and digital citizenship, for example, are expensive- and critical for our children entering the workforce of the future.

As an elementary school principal I can tell you two things we never have enough of- money and time. I would love to have foreign language for fourth graders- or more even just time to immerse students in lessons about kindness - but what do we give up in our packed schedules. And where do we find the money- there is not a growing pot to pull for these increasing needs.

Thank you to everyone who has supported the Franklin Schools- please stay active and informed! Our schools need an active community behind them. I look forward to encouraging my fellow current School committee as they continue this critical work with proven leaders like Mrs. Schultz and Dr. Bergen. 

Alongside some new, incoming members and district leadership I know that they will create a strategic plan to set goals for our district and manage these budgetary constraints. Creative fixes are valiant, but the reality is our schools need more if we want to continue to provide high quality education for all our students- from the highest performing students in need of enrichment and extension, to the most challenged student who so greatly benefit from the various specialized support programs within our district. 

We cannot address the needs of our schools without a commitment to do whatever it takes to provide that to our children. The plight of our public schools here in Franklin are not unique. But given how low we are in terms of funding make these challenges especially alarming. 

So I implore my fellow Franklin citizens- get involved, learn about the needs of our schools and support our talented and dedicated educators in the public schools- with your support and commitment- through most importantly, with your pocketbooks, but also involvement, activism and engagement. 

It is essential that everyone who cares about the future of our town- and especially our children sitting in Franklin Public Schools, get out and vote on Tuesday, November 7th.

Senate Unveils Mental Health ABC Act 2.0: Addressing Barriers to Care

Bill works in tandem with landmark investments in mental and behavioral health
to transform mental health care delivery

Today (11/09/2021), the Massachusetts Senate unveiled its Mental Health ABC Act 2.0: Addressing Barriers to Care (ABC) (S2572), comprehensive legislation to continue the process of reforming the way mental health care is delivered in Massachusetts, with the goal of ensuring that people get the mental health care they need when they need it. This legislation comes at a time when the Massachusetts State Senate is making landmark investments in mental and behavioral health, including $400 million in American Rescue Plan Act (ARPA) funds to transform the behavioral health sector, with $122 million dedicated to recruiting and retaining nearly 2,000 behavioral professionals.

The Mental Health ABC Act 2.0 is driven by the recognition that mental health is as important as physical health for every resident of the Commonwealth and should be treated as such. The bill proposes a wide variety of reforms to ensure equitable access to mental health care and remove barriers to care by supporting the behavioral health workforce.

"This important bill will put policies place to ensure that people get the mental health care they need, when they need it and provide a national model for how we can create an integrated and comprehensive health care system that treats mental health the same as physical health," stated Senate President Karen E. Spilka (D-Ashland). "Out of the darkest days of the COVID-19 pandemic, there is reason for hope, because we are no longer talking about the need for quality mental and behavioral health care in whispers, shamed by stigma. As we all face the emotional difficulties and social isolation of the pandemic, people across our Commonwealth are talking about their struggles with mental health, and the call for quality mental health care is now a roar. I'd like to thank Senators Cyr, Friedman and Rodrigues for their hard work and collaboration on this bill, and the many advocates, individuals and families who have fought for changes to our mental health care delivery system and who have never given up."

"Too many people in Massachusetts struggle to access the mental health services they desperately need and deserve," said Senator Julian Cyr (D-Truro), co-chair of the Joint Committee on Mental Health, Substance Use and Recovery. "The Mental Health ABC Act 2.0 is an important step towards realizing the Senate's vision to transform how the Commonwealth addresses mental health. I am deeply grateful to Senate President Karen Spilka for her leadership and example, and to Senators Friedman and Rodrigues for their partnership in this most urgent endeavor." 

"For far too long, mental health has been a forgotten component of our healthcare system despite our statutory parity mandate that calls for equitable coverage between medical and surgical treatment and mental health treatment," said Senator Cindy F. Friedman (D-Arlington), co-chair of the Joint Committee on Health Care Financing. "This bill serves as a first step forward in addressing the persisting inequities in our delivery of mental health services that keep patients from accessing the care they need, and will provide a framework for the state to better enforce our mental health parity laws. I want to thank Senate President Spilka, Chair Rodrigues, and Senator Cyr for their thoughtful collaboration on this initiative and shared commitment to reforming our mental health care system so it is accessible, affordable, and equitable for all."

"The Mental Health ABC Act 2.0 is a landmark step toward making sure people can get the mental health care they need when they need it," said Michael J. Rodrigues (D-Westport), Chair of the Senate Committee on Ways and Means. "The Senate's targeted investments in mental health in the ARPA bill and the FY22 budget have made it clear that cost of action on this issue is far less than the cost of inaction, for the sake of all residents of the Commonwealth. I applaud Senate President Spilka for her compassionate and steadfast leadership on this issue, and Senators Cyr and Friedman for their diligent work to build upon last session's ABC Act and put forward a comprehensive bill that will ensure equitable access to mental health care for all."

Additions to the original version of the Mental Health ABC Act contained in this legislation include: guaranteeing an annual mental health wellness exam at no cost to the patient; creating an online portal that enables access to real-time data to move patients from emergency to appropriate care; establishing a complex case resolution panel to help resolve barriers to care for children with complex behavioral health needs who find themselves in the emergency room; requiring the Office of the Child Advocate and the Health Policy Commission to issue reports on child emergency department boarding; creating a standard release form; expanding access to psychiatric care by requiring the state-contracted and commercial health plans to cover mental health and substance use disorder benefits offered through the psychiatric collaborative care model; incentivizing investments in acute psychiatric services; and establishing an Office of Behavioral Health Promotion.

The following is an overview of The Mental Health ABC Act 2.0.

Ensuring Equitable Access to Mental Health Care

Guaranteeing Annual Mental Health Wellness Exams. The idea that a person's mental health is just as important as a person's physical health is the cornerstone of this reform. This bill would codify this principle by mandating coverage for an annual mental health wellness exam, comparable to an annual physical.

Enforcing Mental Health Parity Laws. Mental health parity as a concept is simple: insurance coverage for mental health care should be equal to insurance coverage for any other medical condition. This concept has been codified in federal and state law for decades, but enforcement of the law has been challenging. As a result, inequities persist, and patients are often denied coverage for mental health treatment that is every bit as critical to managing their health as treatment for diabetes or heart disease.

This bill provides the state with better tools to implement and enforce our parity laws by creating a clear structure for the Division of Insurance to receive and investigate parity complaints to ensure their timely resolution. Other tools include parity enforcement for commercial, state-contracted and student health insurance plans, greater reporting and oversight of insurance carriers' mental health care coverage processes and policies, and reasonable penalties and alternative remedies for when an insurance company does not comply with the law.

Addressing the Emergency Department Boarding Crisis. For many adults and children in the grips of a mental health crisis, the fastest way to get help is to go to a hospital emergency department (ED). Sadly, when they need to be admitted to an inpatient psychiatric unit, it can be days, weeks, or even months before they're admitted. Meanwhile, the person must often wait in the ED, receiving little to no psychiatric care. This is referred to as 'ED boarding' and it has increased up to 400% since the COVID-19 pandemic began.

Given the severity and urgency of the state's ED boarding crisis, this bill tackles the issue in several ways, by:

  • Creating an ARPA-funded online portal that enables access to real-time data on and includes a search function that allows health care providers to easily search and find open beds using a number of criteria;
  • Establishing a complex case resolution panel to help resolve barriers to care for children with complex behavioral health needs and would include representatives from several state and local health and education agencies working together to ensure a child's behavioral health needs are met in a timely manner;
  • Requiring all hospital EDs to have a qualified behavioral health clinician available to evaluate and stabilize a person admitted to a hospital ED with a behavioral health presentation during all operating hours;
  • Directing the Office of the Child Advocate (OCA) to produce an annual report on child ED boarding; and
  • Tasking the Health Policy Commission (HPC) with conducting a statewide pediatric behavioral health assessment every five years to inform future policymaking.

Addressing ED boarding will help families experiencing acute mental health crises receive timely care.

Reimbursing Mental Health Providers Equitably. Mental health and primary care providers are reimbursed at different rates for the same service. The bill seeks to level the playing field for reimbursement to mental health providers by requiring an equitable rate floor for evaluation and management services that is consistent with primary care.

Reforming Medical Necessity and Prior Authorization Requirements. When an adult or child arrives in an emergency department in the throes of acute mental health crises requiring immediate treatment in an appropriate setting, clinical determinations should be made by the treating clinician. In practice, however, insurance carriers impose too many restrictions on providers' clinical judgement in terms of prior approval and concurrent review requirements for mental health services.

This results in barriers to, and delays in, treatment for patients who need immediate care, creating a dysfunctional system that allows insurance companies to have more leverage in determining a patient's course of treatment than health care providers.

This bill mandates coverage and eliminates prior authorization for mental health acute treatment and stabilization services for adults and children; requires MassHealth and commercial insurance companies to follow a uniform set of criteria established by the American Society of Addiction Medicine (ASAM) for medical necessity and utilization management determinations for treatments for substance use disorder (SUD); and ensures that if a health insurance company intends to change its medical necessity guidelines, the new guidelines must be easily accessible by consumers on the health insurance company's website.

This bill also establishes a special commission to bring all stakeholders to the table to study and make recommendations on the creation of a common set of medical necessity criteria to be used by health care providers and insurance carriers for mental health services.

Creating a Standard Release Form. Behavioral health providers struggle in the era of electronic health records and care coordination to create systems that simultaneously protect an individual's right to consent to share sensitive health information and allow practitioners to access the information they need to treat the individual and coordinate care. This bill would direct the development of a standard release form for exchanging confidential mental health and substance use disorder information to facilitate access to treatment by patients with multiple health care providers.

Increasing Access to Emergency Service Programs. Emergency Service Programs (ESPs), which are community-based and recovery-oriented programs that provide behavioral health crisis assessment, intervention, and stabilization services for people with psychiatric illness, are currently covered by MassHealth. The bill would require commercial insurance companies to cover ESPs as well.

Expanding Access to the Evidence-Based Collaborative Care Model. The collaborative care model delivers mental health care in primary care through a team of health care professionals, including the primary care provider, a behavioral health care manager, and a consulting psychiatrist. This evidence-based access to mental health care has proven effective, less costly, and less stigmatizing. The bill would expand access to psychiatric care by requiring the state-contracted and commercial health plans to cover mental health and substance use disorder benefits offered through the psychiatric collaborative care model.

Reviewing the Role of Behavioral Health Managers. Some insurance companies have subcontracted mental health benefits to specialty utilization management companies for years with mixed results. The bill directs the Health Policy Commission, in consultation with the Division of Insurance, to study and provide updated data on the use of contracted mental health benefit managers by insurance carriers, often referred to as "carve-outs." 

Incentivizing Investment in Acute Psychiatric Services. This bill would create an exemption from the Department of Public Health's determination of need process to incentivize health care facilities to invest in and develop more acute psychiatric services across the Commonwealth, including inpatient, community-based acute treatment, intensive community-based treatment, a continuing care unit and partial hospitalization programs.

Tracking and Analyzing Behavioral Health Expenditures. This bill includes a critical first steps toward incentivizing greater investments in mental health care within the analysis of statewide health care cost growth. Specifically, the bill directs the Center for Health Information and Analysis (CHIA) to define and collect data on the delivery of mental health services to establish a baseline of current spending; and directs the Health Policy Commission (HPC) to begin tracking mental health care expenditures as part of its annual cost trends hearings.

Establishing an Office of Behavioral Health Promotion. Current behavioral health services are spread across state agencies. This dilutes the responsibility for mental health promotion and focus on the issues and undermines the important work being done. This bill would establish an Office of Behavioral Health Promotion within the Executive Office of Health and Human Services (EOHHS) to coordinate all state initiatives that promote mental, emotional, and behavioral health and wellness for residents.

Increasing Access to Care in Geographically Isolated Areas. This bill would direct the Department of Mental Health (DMH) to consider factors that may present barriers to care—such as travel distance and access to transportation—when contracting for services in geographically isolated and rural communities.

Removing Barriers to Care by Supporting the Behavioral Health Workforce

Creating a Roadmap on Access to Culturally Competent Care. This initiative builds off an academic study mandated and funded through the Commonwealth's Fiscal Year 2021 budget to review the availability of and barriers to accessing culturally competent mental health care providers. Under this provision, an interagency health equity team under the Office of Health Equity, working with an advisory council, would make annual recommendations for the next three years to improve access to, and the quality of, culturally competent mental health services. Paired with the Senate's ARPA investment of $122 million in the behavioral health workforce through loan repayment assistance programs, this roadmap will make great strides toward building a robust workforce reflective of communities' needs.

Allows for an Interim Licensure for Licensed Mental Health Counselors. The bill would create an interim licensure level for Licensed Mental Health Counselors (LMHCs) so that they can be reimbursed by insurance for their services and be eligible for state and federal grant and loan forgiveness programs, further increasing the number of licensed providers able to serve patients.

Expanding Mental Health Billing. This bill would allow clinicians practicing under the supervision of a licensed professional and working towards independent licensure to practice in a clinic setting. This will help to ensure quality training and supervision and encourage clinicians to stay practicing in community-based settings.

Updating the Board of Registration of Social Workers. The bill would update the membership of the Board of Registration of Social Workers to clarify that designees from the Department of Children and Families (DCF) and Department of Public Health (DPH) be licensed social workers.

This legislation builds upon the original Mental Health ABC Act, passed by the Senate in 2020, important provisions of which have been signed into law, including:

  • Standardizing credentialing forms, which shortens the amount of time it takes for newly hired mental and behavioral health professionals to be approved for inclusion in an insurance network, increasing access to care.
  • Requiring coverage for same day care, removing a significant financial barrier to the integration of primary care and mental health.
  • Creating a tele-behavioral health pilot program, which authorized three pilots for tele-behavioral health services in public high schools in the Commonwealth.
  • Creating a psychiatric mental health nurse practitioner fellowship pilot program, which offers additional support and training to psychiatric nurse practitioners who agree to work in community settings with underserved populations.
  • Creating a mental health workforce pipeline to encourage and support individuals from diverse backgrounds to choose careers in mental health by emphasizing that it is valued and important work.
  • Studying access to culturally competent care to review the availability of culturally competent mental health care providers, as well as to identify potential barriers to care for underserved cultural, ethnic and linguistic populations, the LGBTQ+ community, and others.

This legislation also comes at a time when the Massachusetts State Senate is making transformative investments in mental and behavioral health, including:

  • $400 million in American Rescue Plan Act (ARPA) funds to transform the behavioral health sector, with $122 million dedicated to recruiting and retaining nearly 2,000 behavioral professionals.
  • $10 million annually for the newly-created Behavioral Health Outreach, Access and Support Trust Fund, which funded the highly successful More to the Story public awareness campaign.
  • $10 million for the rapid creation of new inpatient mental health acute care beds, particularly new beds for children, adolescents and underserved communities.
  • $15 million for Programs of Assertive Community Treatment (PACT) for children who exhibit symptoms of serious emotional disturbance; PACT uses a multidisciplinary team approach to provide acute and long term supports for individuals in the community.
  • $3 million for a loan repayment assistance program to recruit and retain child and adolescent psychiatrists at community mental health and health centers.
