Recap: Franklin Housing Authority meeting 2/07/22

Quick recap:

• The Franklin Housing Authority met on Monday, Feb 7 at 4:30 PM in the community room at Central Park terrace
• Key item - waiting list has over 8 thousand individuals, only 300 odd are from Franklin. It is good t have Franklin a desirable community but we need more housing
• The four units out of service from the fire in 2021 may be back online in March. Currently empty units being filled as applicants are vetted and arrangements confirmed
• Revenue up over this time last year, attributed to better management of rental payments coordinating with residents on the timing of the Social Security funds, etc.
• Director contract extended for 5 year term using current contract language. The DHCD template is in court being challenged on some of the provisions  and the resolution is not anticipated any time soon. Hence, the renewal of the current contract terms

"Blow for Uber as judge finds California’s gig-worker law unconstitutional"

A case that will have implication for MA as there is a proposed ballot question for 2022 on this issue.

"A judge on Friday struck down a California ballot measure that exempted Uber and other app-based ride-hailing and delivery services from a state law requiring drivers to be classified as employees eligible for benefits and job protections.

Alameda county superior court Judge Frank Roesch ruled that Proposition 22 was unconstitutional.

Voters approved the measure in November after Uber, Lyft and other services spent $200m in its favor, making it the most expensive ballot measure in state history.

Uber said it planned to appeal, setting up a fight that could likely end up in the California supreme court."

Franklin, MA Town Council Meeting - audio recording of 07/21/21 - three parts

FM #582, 583, and 584 = This is the Franklin Matters radio show, number 582, 583, and 584 in the series. 

This session shares part of the Franklin, MA Town Council meeting held on Wednesday, July 21, 2021. 

The meeting was conducted in a hybrid format: members of the Town Council and Town Administration personnel were in the Council Chambers, some of the public participated in person, some were remote via the Zoom conference bridge, as we move to come out of this pandemic period.

I’ve split the almost 3 hour meeting into three logical segments:

• First - covers the opening with 3 recognitions, and the public hearing on the tasting room definition zoning bylaw change (~37 mins)

• Second - covers the Dean College alcohol license discussion and new vote. Dean had been denied in 2020, appealed to the ABCC, and the ABCC determined the Council had improperly denied the license. (~1:09  or 69 mins)

• Third - covers the legislation for action including funding approval and acceptance of the first right of refusal for the Maple Hill purchase with CPA funds. They enter Executive Session and return about 30 minutes later. The update on the Town Administrators contract was provided, approved via vote, and then the meeting closed. (~44 minutes)

FM #406 = This is the Franklin Matters radio show, number 406 in the series.

This session shares the Franklin, MA Town Council meeting held on Wednesday, Dec 2, 2020.

The meeting was conducted in a hybrid format: members of the Town Council, selected guests, and Town Administration personnel were in the Council Chambers, the public was remote via Zoom conference bridge, all to adhere to the ‘social distancing’ requirements of this pandemic period.

I’ve split the full four hour plus meeting into three logical segments:

• First - covers the opening through the first public hearing on the tax rate and subsequent votes to approve 14.65% as the rate for FY 2021 (1 hour and 5 minutes)
• Second - covers two of the public hearings; the Comcast contract renewal for 10 years, and the bylaw fee adjustment to reduce the fees for next year only to help the local restaurants during this COVID-19 pandemic period (36 mins)
• Third - covers the presentation on the spear phishing incident through to the meeting close. There was a 4 minute recess during this segment, I did remove most of the silence to reduce the time for this segment (where I could) (2 hours and 17 minutes)

Town Administrator Jamie Hellen address the Council on the Comcast contract and bylaw fee adjustment

Town Council Meeting: Comcast contract, Spear phishing update, tax rate set

Quick Recap:

• Acting Town Clerk Nancy Danello reminds folks of the election Dec 5 
• Discussion on election 'rules' raised during citizen comments - debunked in Council discussion later, there are MA MGL and US voting rights statues but not the '30 page or rules doc mentioned'
• tax rate hearing was held. rate set at 14.65, a .14 cent increase of last year. The rate is a calculation that allows only a decision on a single rate or dual. Franklin is not in a position to use a dual rate so the Council voted for a single rate. The rest is a math exercise. I'll simplify the analysis later.
• Comcast cable contract came up for renewal, new one has a ten year term (good for us) as it enables Franklin to chose between Verizon or Comcast (or 'cut the cord'). Almost 5,000 user for Comcast in Franklin. One of the cable fees on both the Verizon and Comcast bill is what funds the Franklin TV cable operations (and coincidently an item on the agenda Weds was the quarterly transfer of funds from Verizon through Town of Franklin to Franklin TV - purely a pass through for accounting purposes)
• The bylaw to provide a reduction in license renewals for restaurants was approved at this second reading. It costs the Town approx. $13K in 'lost revenue' but will help each of the business in this pandemic period.
• Insights on the cyber theft incident were provided (finally) as the investigation (still ongoing) had developed enough info to be able to share. It was a target attack to the Treasurer/Collector over two months of email that led to a change in the processing of a payment that resulted in the diversion of funds. It was discovered in Sept when the real legitimate vendor came looking for their promised payment that had not been received. 
• The individual was suspended, salary reduced and will maintain position as this (while a significant mistake) was the only blemish on her work
• At one point in the meeting she stood up to apologize publicly (well done) 
• The investigation continues. The Town has obtained $200K from insurance to cover the loss. 
• The balance will come from the emergency fund within the water enterprise account (already set aside for emergencies - usually for broken water mains)
• There is a possibility of recovery of the funds. 
• There is no need to raise rates to cover for the loss
• Procedures were in place for creation of a wire transfer. Procedures will be modified to cover a change in a payment process.
• Additional training on cyber awareness will be conducted. All Town side personnel and School department central office personnel are currently part of this regular training (oddly, teachers (the largest segment of Town employees are not yet covered))
• After the presentation, a combined effort from Technology Director Tim Raposa, Police Chief TJ Lynch, and Town Administrator Jamie Hellen, the Council took a 3 minutes recess before getting into their Q&S and statements

• Cable attorney provides insights and argument for the long term contract, it is a win-win for Franklin, this meeting and broadcast of it is funded by the contract. If folks aren't happy they can shift to Verizon or cut the service. Enforcing the license is the easy part #tc1202

Town Council Recap: reluctantly approves water rate increase

• The Town Council heard a presentation on the Market Study performed by MAPC. Details of the study will be picked up for action by the Economic Development Subcommittee (beginning July 30 6:00 PM).

• The Town Council heard a presentation on the PACE Program and voted to enroll in it so businesses (for profit or non-profit) can take advantage of this opportunity.

• The Town Council 'reluctantly' voted for the final time to approve the water rate increase which has been planned for years and most recently (March 2020) was also cause of much discussion around the 'poor timing.' Poor timing because we are in the middle of a pandemic, folks are economically stressed or hurting, and we are also in the middle of construction to fix the water treatment for wells 3 & 6 which if we didn't would result in a default on contracts and likely larger legal fees that the water rate increase will raise. Oh, and by fixing the wells we get access to over 700,000 gallons of water which we need.

• The meeting was the first conducted with Zoom installed in the Council Chambers for the Council to be physically together in person. The meeting technically was a success broadcast via Zoom, the cable channels, and live streamed via Franklin TV.

• Municipal opt in a one time requirement, hence the vote by TC tonight #tc0729 energy cost savings must be cost positive, 3rd party capital provider. Property placed on a lien if approved.

• Pellegri, no fee to participate in program. Because of payment via betterment assessment need the municipal approval, just launched this week
• #tc0729 Bissanti, property owner gets energy audit or Mass development? Property owner does and then comes to us to help facilitate the financing agreement. Advantage is long term, 20 years. Assessment secured by a lien

• #tc0729 is there any place we could take for this? $500,000 a year. About 40/unit. Water conservation is the annual useage with limit of once per week allowance; the water ban eliminates the once a week allowance due to drought this year and in 2016? And last year's fire
• #tc0729 it is a utility and a use, this fixes and pays for our infrastructure. Yes it is an expense. Gallon costs less than a tenth of a cent from Franklin (not the Poland spring rate) where would we find a half million to finish the projects, if we don't find it, we default
• #tc0729 people can regulate the water being used to a sense, if we don't approve we're in trouble. We're pigeon holed, for funding this. What have we done with the usage year over year, how much is there a change? What about the dual water meter option? Bring someone in

Town Administrator's report through to closing

• Re-opening, inspections resuming! Assessor inspections resumed, recreation bball started one of few
• #tc0729 concerts on the common started last week, good to see, check the schedule, food trucks coming, do the right thing, we can continue to expand, coordination with Farmers market; about $100k through a grant process for businesses locally details coming by end of month
• #tc0729 FY 2020 revenue came in at 102% so we did cover all our bills. Thanks to fire dept for the pinning date; thanks for Pete and Franklin TV to be back here in Chambers, feels good to be here
• #tc0729 question on accept of private roads; people are happy with the nets at the high school; thanks to Franklin TV; thanks to chief McLaughlin for the ceremony last week, hybrid meeting tonight, almost normal; first class event last week, made a good decision last year
